Former Georgia election workers Ruby Freeman and Shaye Moss will seek between $15.5 million and $43 million from Rudy Giuliani at a defamation trial slated to begin next month in a Washington, D.C., federal court, attorneys for the mother and daughter wrote in court documents filed Tuesday.

A federal judge has already found Giuliani liable for defamatory comments he made about the pair in the wake of the 2020 election, including unfounded claims that they fraudulently manipulated ballots on Election Day in front of cameras at State Farm Arena.

According to Freeman and Moss' legal team, the range of $15.5 million to $43 million cited in court papers includes costs associated with Moss' loss of work and her "need to secure and relocate from her home," where ABC News interviewed her in 2022.

The civil trial, scheduled to begin Dec. 11, will determine the full scope of damages.

Fulton County District Attorney Fani Willis is asking a judge to revoke the bond agreement for one of Donald Trump’s co-defendants in her election interference case, citing what she says is a “pattern of intimidation” toward co-defendants and witnesses.

Willis said Harrison Floyd has “engaged in numerous intentional and flagrant violations” of his bond agreement. She pointed to recent comments Floyd made on conservative podcasts and posts on the social media site X that tag Secretary of State Brad Raffensperger, former Fulton County poll worker Ruby Freeman and others.

“The defendant’s actions demonstrate that he poses a significant threat of intimidating witnesses and otherwise obstructing the administration of justice in the future, making him ineligible for bond,” Willis wrote in a court filing on Wednesday.
If Fulton Superior Court Judge Scott McAfee agrees, Floyd would be forced to return to jail as he awaits trial. It was not clear when McAfee would schedule a hearing on the matter.
Floyd’s two attorneys did not immediately respond to phone calls seeking comment.

11/15/23 Update: Motions hearing. Jonathan Miller, an attorney for former Coffee County election supervisor Misty Hampton, acknowledged sharing the confidential evidence with a media outlet. Willis’ prosecutors wanted a blanket order on all the evidence. Co-defendant David Shafer’s legal team proposed an alternative in which the state would specifically designate certain evidence as sensitive. Prosecutors agreed with Shafer’s counter-proposal, as did most of the defense attorneys for the other indicted co-conspirators, including Trump attorney Steve Sadow. Prosecutors for the DA’s office clarified that they are prepared to go through all the evidence & make those designations, noting that things like proffer videos, personal identifying information & sensitive business records would be designated as sensitive. The state, in agreeing to Shafer’s proposal, withdrew their motion that said proffered or other sensitive video evidence would be viewable by defense counsel only in a secure office. Attorneys for all but two of the defendants, John Eastman & Michael Roman, were present at the hearing, and all agreed to Shafer’s proposed order. A few noted their objection to any order overall, but said they would not argue against the majority will of the other defense attorneys & the court. Did not agree: Catherine Bernard, an attorney for former Justice Dept. official Jeffrey Clark & Chris Kachouroff, an attorney for Harrison Floyd.

"Harrison Floyd, a co-defendant of former President Donald Trump in the Georgia 2020 election case, will remain out of jail after a Fulton County judge ruled Tuesday that he will not revoke his bond.

Instead - he modified it.

Fulton County Superior Court Judge Scott McAfee signed Floyd's $100,000 modified bond order Tuesday evening after the hours-long hearing.

As part of the order, Floyd was ordered not to make any public statement concerning any co-defendant or witness in connection to the case. Floyd also can't post on social media platforms of any kind, public or private, concerning the case."

11/21/23 Update: Floyd: Superior Court Judge Scott McAfee declined a request to revoke the bond for Floyd. Willis filed a motion last week asking Superior Court Judge Scott McAfee to revoke Floyd’s bond. In her first in-person appearance in this case since the indictment, she argued in court that Floyd has been attempting to intimidate & contact likely witnesses & his co-defendants in violation of the terms of his release. Floyd’s lawyers argued that his social media posts are constitutionally protected speech & that he was in no way trying communicate with or intimidate any witness or co-defendant. McAfee said there is no constitutional right to bail & that bond orders can contain conditions that curtail a defendant’s rights, but he also noted that people are generally allowed to publicly criticize the merits of the case but cannot cross a line. He said Floyd appears “very boldly willing to explore where that line is” in this case. McAfee said he did believe there had been a “technical violation” of Floyd’s bond conditions but that not all violations merit revocation. After discussion with the lawyers & over some objections from Floyd’s attorneys, McAfee signed a modified bond order proposed by prosecutors. The new bond conditions say Floyd shall have “no contact” with or do anything to intimidate any co-defendant, witness or person named in the indictment. They also prohibit him from making any public statement about any of those people & from posting anything about them or contacting them in any way on social media. That includes not interacting with a post by any other user that would violate the order if he had been the one who posted it.

*Scott Graham Hall - (fake GOP elector tied to Coffee County breach) Plead guilty (9/29/23) & sentenced to 5 years of probation in exchange for testimony moving forward (including at trials of other co-defendants), a $5K fine & 200 hours of community service. Probation becomes non-reporting after 2.5 years, assuming he does not violate his probation during those initial 2.5 years. And will have to write letter of apology to Georgia citizens.
*Sidney Katherine Powell (68) - took a plea deal & plead guilty to 6 counts of conspiracy to commit intentional interference with performance of election duties & sentenced to 6 years probation, required to testify at future trials, pay at $6K fine & #2,700 in restitution to the State & write an apology letter to the citizens of Georgia & admit her role in the January 2021 breach of election systems in Coffee County.
*Kenneth John Chesebro (61/now 62) – took a plea deal (10/20/23) & plead guilty to Count 15 Conspiracy to commit filing false documents. All other charges dismissed. Sentenced to 5 years probation, $5K restitution fine, 100 hours of community service & an apologize letter to the citizens of Georgia & testify against all other co-conspirators truthfully. Also no communication with media, witnesses & co-defendants, recorded proffer with prosecutors, provide documents & evidence. Resides in Puerto Rico & Judge will see if he can get probation transferred there. As part of his plea deal, Chesebro admitted that he conspired to put forward fake GOP electors in Georgia with Trump & former Trump lawyers Rudy Giuliani & John Eastman. Giuliani & Eastman have both pleaded not guilty in the Georgia case & now face the prospect of Chesebro taking the witness stand against them."
*Jenna Lynn Ellis (38/now 39) – Took a plea deal to charge of aiding & abetting false statements & writings. Ellis plead guilty on 10/24/23. Sentenced to 5 years probation, $5K fine, apology letter to the citizens of Georgia, 100 hours of community service & testify truthfully against other co-defendants.

Judge rejects Trump's immunity claim in 2020 election case​


A federal judge has dismissed ex-President Donald Trump's bid to throw out charges of election interference on the basis of "presidential immunity".

Mr Trump's lawyers had argued his attempts to reject the 2020 results fell within his duties as president.

But Judge Tanya Chutkan found no legal basis for concluding presidents cannot face criminal charges once they are no longer in office.

Mr Trump is accused of unlawfully trying to overturn his election defeat.

"Whatever immunities a sitting president may enjoy, the United States has only one chief executive at a time," Judge Chutkan wrote late on Friday.

"That position does not confer a lifelong 'get-out-of-jail-free' pass."

Judge Chutkan's answer's to Trump's lawyer's arguments included warnings issued by George Washington, who cautioned that "cunning, ambitious and unprincipaled men" would take advantage of "all obstructions to the exectution of the law".
