New judge to hear case against AJ Freund's caseworkers (dailyherald.com)

An out-of-county judge will be brought in to the McHenry County courthouse to preside over the cases of two caseworkers charged criminally in the death of a 5-year-old Crystal Lake boy who was killed by his parents in 2019.

Judge James Cowlin, who is serving as chief of the 22nd Judicial Circuit until his term ends Nov. 30, has replaced the now-retired Judge Robert Wilbrandt. On Dec. 1, Michael J. Chmiel will take over as the new chief judge.

Wilbrandt had been overseeing all matters related to the death of AJ Freund, including the criminal cases of his parents, JoAnn Cunningham and Andrew Freund.

Wilbrandt also had been presiding over the cases of Carlos Acosta and Andrew Polovin, employees with the Department of Children and Family Services. Acosta was assigned as AJ's caseworker, and Polovin was Acosta's supervisor.

In a rare move, each has been charged criminally in the child's death.

On Friday, Cowlin told attorneys for Acosta and Polovin that he had a conflict presiding over the cases because, in his role as chief judge, he goes before the McHenry County Board on budget issues and other matters, and Acosta is a county board member.

Acosta, 56, of Woodstock, and Polovin, 49, of Island Lake, are each charged with two counts of endangering the life of a child and health of a minor, Class 3 felonies, and one count of reckless conduct, a Class 4 felony, related to their handling of AJ's case.

If convicted on the most serious charges of child endangerment, a Class 3 felony, they could face between five and 10 years in prison.

Before Wilbrandt, Cunningham pleaded guilty to first-degree murder and was sentenced to 35 years in prison. Freund also pleaded guilty before Wilbrandt, and he is serving a 30-year prison sentence.

Acosta's and Polovin's next court date is Aug. 30. Neither man was present at court Friday.

Illinois suspends law license of man accused of killing son

Illinois officials have suspended the law license of a suburban Chicago man charged in the beating death of his 5-year-old son AJ Freund.

The state's Attorney Registration and Disciplinary Commission disclosed Monday the license of 60-year-old Andrew Freund of Crystal Lake will remain on suspension until further ruling by the Illinois Supreme Court. He's awaiting trial on charges he murdered his 5-year-old son, AJ.

The Arlington Heights Daily Herald reports Freund previously had his license suspended in 2015 over his work in the divorce case of AJ's mom, JoAnn Cunningham, who's also charged in the boy's slaying.

Not too sure - they keep moving the hearings - and not much is being done. Hopefully with this new judge it might move forward again.

That is part of the problem, should each child have a separate file? Or "family file" with each child having a separate folder. It gets confusing, when you have medical, educational, psychological, legal, case management paperwork for each family member.

Just a case management issue, because file management could be part of the reason why so many kids fall through the cracks. And you may not have the whole picture, because medical records for all injuries may not have been reported, and are not part of the main DCFS file.

I'm shocked to learn that medical records are not part of the main DCFS File. Is that true in every state? It seems that medical records would be a critical component for assessing the welfare of a minor. MOO

*Status Hearing for both (@ 9am CT) – IL – Andrew “AJ” Freund, Jr. (5) (reported missing April 17, 2018, Crystal Lake; found buried in shallow grave on April 24, 2019, near Woodstock) – *Carlos J. Acosta (54/now 55) arrested, charged & indicted (9/10/20) & arraigned (9/24/20) with 2 felony counts of endangering the life of a child & 1 felony count of reckless conduct. $20K bond (bonded out 9/10/20). Plead not guilty. Balance due: $2K bond.

*Andrew R. Polovin (48/now 49) arrested, charged & indicted (9/10/20) & arraigned (9/17/20) with 2 felony counts of endangering the life of a child & 1 felony count of reckless conduct. Plead not guilty. $20K bond. (bonded out 9/11/20).

6/24/22 Update: Defendant's motion for continuance; Motion in Limine. Next status hearing re trial date on 7/29/22. 7/29/22 Update: An out-of-county judge will be brought in to the McHenry County courthouse to preside over the cases of two caseworkers. Judge James Cowlin, who is serving as chief of the 22nd Judicial Circuit until his term ends Nov. 30, has replaced the now-retired Judge Robert Wilbrandt. On Dec. 1, Michael J. Chmiel will take over as the new chief judge. Judge Wilbrandt had been overseeing all matters related to the death of AJ Freund, including the criminal cases of his parents, JoAnn Cunningham & Andrew Freund. On Friday, Judge Cowlin told attorneys for Acosta & Polovin that he had a conflict presiding over the cases because, in his role as chief judge, he goes before the McHenry County Board on budget issues & other matters & Acosta is a county board member. Court’s motion to continue to set trial date on 8/30/22.
*JoAnn D. Cunningham (35/now 38) – 12/5/19: Plead guilty. Sentenced on 7/17/20 to 35 years in prison. Post conviction petition hearing on 6/1/22. Post conviction petition denied/dismissed.
*Andrew T. Freund, Sr. (60/now 63) – 9/18/20: Plead guilty. Sentenced on 9/18/20 to 30 years in prison. Will help prosecutors with case against welfare workers. On Jan. 21, the ARDC announced Andrew T. Freund, licensed as an attorney since 1984, had been disbarred after being convicted last year of involuntary manslaughter, aggravated battery of a child and concealment of a homicidal death.
