The DNA test showed that Daniel Nowicki Jr., 36, who previously lived with JoAnn Cunningham in Crystal Lake, is the father of her daughter, who was born May 31, a source said.

McHenry County prosecutors are seeking to revoke Cunningham’s and Freund’s parental rights to the 4-year-old.

Paternity results released Monday could have bearing on the custody of the newborn daughter.

The paternity findings do not affect the pending criminal case, said attorney Henry Sugden III, who is defending Andrew Freund against multiple felony charges, including concealment of a homicidal death. Freund and Cunningham remain in jail on $5 million bail each.
Paternity test reveals who is the father of newborn girl born to mom of slain 5-year-old Crystal Lake boy AJ Freund; results could affect custody case

It will be interesting to see if the sperm donor of the baby girl receives any parental privileges. What a mess these people created for the innocent children who survived the horror show.

I know AJ will receive justice, patiently waiting for that day.

The Chicago Tribune reported that during the hearing, Assistant State's Attorney Randi Freese told the judge that prosecutors are trying to find out if Cunningham was taking drugs around the time her son was killed. (More via Chicago Tribune).

Prosecutors in the case recently asked that patient-doctor privilege (confidentiality) be surrendered, citing how the mother's potential drug use might have had some relation to the child's death.

According to state law, "No physician or surgeon shall be permitted to disclose any information he or she may have acquired in attending any patient in a professional character, necessary to enable him or her professionally to serve the patient."

However, there are a few exceptions, including trials for homicide "when the disclosure relates directly to the fact or immediate circumstances of the homicide," and more.

Andrew Freund was tested early and found mentally fit to stand trial. Four months later, the prosecutors are now petitioning for JC's doctor's information re any drug use, in case it might have some relation to AJ's death. Are they looking for proof of her taking (or not taking) prescription drugs (eg anti-depressants) which can cause aggression and violence in some people? I don't think people like JC would admit to their family doctor that they take street drugs, but maybe they want to get her doctor's assessment on what he noticed.

IMO, the prosecution want to rule out any excuses JC's defense might present, the same way they ruled out AF not being fit to stand trial. jmo

Thanks MyBelle - but unfortunately I can't access this article, even with the "Outline" site.

Does it say "what date" next hearing is? TIA! :)

It does not.

Judge Christopher Harmon, who is presiding over the McHenry County shelter court hearings of both of AJ’s younger siblings, continued the cases until late next month as lawyers await further records from the Illinois Department of Children and Family Services.
