A main argument in the cross examination of Galipeau from the defense was that the facility doesn’t currently hold any pre-trial detainees. Everyone in the maximum security part of the facility has been charged with a crime.

During closing remarks the defense says he understands all the “safety concerns” from the other facilities, when it comes to housing Allen.

Rozzi says it is unfair to compare Allen to other inmates “down the hall” because he hasn’t been charged with a crime. They have.

He says he has “ no time to focus on the important things in this case.”

When talking about the Westville facility, Rozzi said “I think they’re tired of me and I don’t blame them. But I have a job to do.”

McLeland said Allen “confessed five or six times.” Saying “He [Allen] made multiple confessions to multiple people.”

Rozzi acknowledged the confessions, saying Allen had made "incriminating statements" while at Westville Correctional Facility.

Rozzi also claimed those statements should not be trusted because of Allen’s mental state. “Confessions, non-confessions, incriminating statements, non-incriminating statements, we’ll deal with that. The jury will hear all of that.”

Judge Gull told Allen’s defense that it sounded like they just wanted him moved to be convience to them. She stated that the attorneys knew he was in Westville, when they were appointed the case and agreed.

The state said they didn’t have any huge concern where Allen was placed, their main request is that they want him held on no bond.

DELPHI, Ind. – Prosecutor Nick McLeland said in court Thursday that Richard Allen “confessed five or six times” that he killed best friends Abby Williams and Libby German on remote historic trail in Delphi in February 2017.

“He made multiple confessions to multiple people,” McLeland said on Thursday.

Richard Allen’s defense attorney acknowledged “incriminating statements” made by Allen but attributed the comments to his client’s deteriorating mental state.

“He has made incriminating statements implicating himself in the crime,” said Allen’s defense attorney, Bradley Rozzi.

Defense attorneys and prosecutors made arguments in court Thursday about statements previously made by Delphi murder suspect Richard Allen, including the reported “confessions” of the murders.

The probable cause affidavit unsealed in November 2022 indicated that investigators found an unspent round near the girls’ bodies. A forensic expert determined the bullet had been ejected from Allen’s Sig Sauer Model P226.

Allen’s attorneys are challenging that evidence, but Gull pushed back a hearing on that specific aspect of the case to a later date.

The judge also indicated that several documents related to the case that have been kept under seal would be made available on a website.

Ultimately, jury selection was scheduled to take place on Jan. 8, 2024, which will kick off the trial into the Delphi murders and determine if Allen is found guilty or innocent of committing the crime. The trial is expected to last three weeks at the Carroll County Courthouse. Jurors will be selected in Allen County and bussed to Delphi.

DELPHI, Ind. — Defense attorneys want a judge to restrict important evidence that investigators say links a Delphi man to the murders of two teenage girls.

Attorneys for Richard Allen have filed a “motion in limine regarding ballistics,” which is a pretrial motion asking that certain ballistics evidence be excluded from trial.

[...] Allen is charged in the murders of Abby Williams and Libby German, who were found dead in a wooded area near Delphi’s Monon High Bridge in February 2017.

According to a probable cause affidavit, investigators found a .40 caliber unspent round at the crime scene between the girls’ bodies. Years later, as police focused their investigation on Allen, they found a gun inside the suspect’s home as they served a search warrant. When Indiana State Police analyzed that gun at their crime lab in late 2022, they determined the unspent round located at the murder scene had cycled through Allen’s gun, according to court documents. A week later, Allen was arrested and charged with two counts of murder.

The prosecution said Allen “confessed five or six times to killing the girls.”

The defense team said the vague statements are inconsistent with Allen’s previous statements of denial.

DELPHI, Ind. (WXIN) — Responding to a request filed by a podcaster and attorney, Allen County Judge Fran Gull announced that she would release some sealed documents in the Delphi murder case against Richard Allen this week.

[...] Podcaster Kevin Greenlee of “The Murder Sheet” recently filed a request with Judge Gull to reconsider the seals.

”In this case, things were being filed, the defense was not asking for them to be sealed, the prosecution was not requesting them to be sealed, but they were all getting sealed,” said Greenlee. “That violates the procedure and actually resulted in a lot of confusion for the public about what’s actually going on in this important case.”

Podcaster Aine Cain said the media and the public were left to examine court appearance statements and speculate on pertinent details of the case because of the secrecy.

The motion states:

"On April 3, 2023, Richard M Allen made a phone call to his wife Kathy Allen. In that phone call, Richard M Allen admits several times that he killed Abby and Libby. Investigators had the phone call transcribed and the transcription confirms that Richard M Allen admits that he committed the murders of Abigail Williams and Liberty German. He admits several times within the phone call that he committed the offenses (sic) as charged. His wife, Kathy Allen, ends the phone call abruptly."

"Richard M Allen was wetting down and paperwork he had gotten from his attorneys and eating it, he was refusing to eat and refusing to sleep. He would go days of refusing to sleep. He further broke the tablet that he used for text messages and phone calls. He went from making up to two phone calls a day as of April 3, 2023 to not making any phone calls at all.”

Newly unsealed documents in the Delphi murders case reveal how Indiana investigators tied a local CVS employee to the 2017 crime and how the girls might have been killed.

Investigators believe Richard Allen used a "sharp object" to kill Liberty "Libby" German, 14, and Abigail Williams, 13, Feb. 14, 2017, while the two teen girls were walking on a popular hiking trail in Delphi, court documents unsealed Wednesday revealed.

On November 3, 2022, the Judge of the Carroll Circuit Court, at the request of the Carroll County Sheriff, entered the following order: "Accordingly, pursuant to Ind. Code 35-33-11-1, the Court ORDERS the Sheriff of Carroll County to transfer Defendant to a facility of the department of correction designated by the commissioner of the department as suitable for the confinement of Defendant and provided that space is available." These types of orders are referred to as "safe keeper" ordered. The Department of Correction has complied with this order. Consistent with that Order and the "safe keeper" statute, the Department of Correction is authorized to move the Defendant within the Department of Correction to accommodate his medical and physical needs pursuant to medical directives by the Department of Correction physicians, psychiatrists or psychologists

Courthouse will open at 8:00 a.m. All entrances will be closed, except for the handicapped entrance on the north side of the building. The remaining entrances will be locked with no access to the public. All members of the public, including members of the media, are subject to screening by metal detectors. All bags in possession of those entering the building are subject to search. NO weapons of any kind are permitted in the building, except for on-duty law enforcement officers providing security to the Courthouse and the parties. Cellular telephones are permitted in the building, but must be powered OFF and unused at all times while in the building or the Courtrooms. Violations are subject to seizure and destruction of the cellular telephone. No electronic equipment or devices are permitted in the Carroll Circuit Court. Media personnel are permitted to attend the Court session. NO cameras, electronics, lap tops or recording equipment of any kind is permitted on the Second Floor and the Third Floor of the Courthouse nor inside the Circuit Courtroom. All such equipment is limited to the First Floor of the Courthouse. The Court requests the media be mindful that other County offices are conducting business in the building unrelated to this case. Media and members of the public are ordered to conduct themselves in such a fashion as to limit disruption to the offices, personnel, and patrons of those offices. The Media are free to use the public areas outside the Courthouse as long as they do not obstruct traffic in the streets and sidewalks surrounding the Courthouse. Seating in the Carroll Circuit Court is limited. The first row of public seats behind the bar separating the well of the courtroom from the public is unavailable for seating. The Sheriff of Carroll County or his designee will ensure that the victim representatives are seated. The remaining seating is available until full. No one, other than Court Security, will be permitted to stand in the Courtroom. All spectators must remain seated until the conclusion of the hearing and the parties have left the Courtroom. No food or beverages are permitted inside the Carroll Circuit Court. Water will be permitted for the parties in the well of the Courtroom. All members of the public and the media are required to follow directives of the Sheriff of Carroll County, Courthouse Security and Courtroom Security. NO court-produced recording will be made available to the public or media. The audio record made pursuant to Indiana Criminal Rule 5 may not be copied or used for purposes other than perpetuating the record. At the conclusion of the scheduled hearing on public pending Motions before the Court, the Court will conduct an ex parte hearing with the Defendant and defense counsel on the Ex Parte Motion. The State of Indiana and the public are excluded from this portion of the hearing and will be asked to leave the Courtroom. Court Security will remain and are ordered to keep that portion of the proceeding confidential. The Court anticipates that all members of the public and the media will conduct themselves in an appropriate fashion. Any violation of this Order and any conduct the Court finds disruptive of the proceedings may result in an order of temporary or permanent exclusion from the Courtroom and/or Courthouse and is punishable as contempt of Court.

The Court has reviewed the electronic file recently and discovered many pleadings and filings have been marked as sealed and confidential, and, therefore, unavailable to the public The Court has consulted with Counsel for the State of Indiana and the Defense and discovered the pleadings have been deemed confidential to comply with the Court Order dated December 2, 2022 which prohibits public comment, commonly referred to as the "Gag Order". Counsel agree with the Court that the public interest is best served by transparency, but that certain pleadings should remain sealed. Counsel agree that the original, unredacted Affidavit for Probable Cause shall remain sealed as it lists names of juvenile witnesses; that the Transport Orders previously entered (and future Orders) shall remain sealed for security purposes; and that the Defense Ex Parte Motions and related Orders shall remain sealed pursuant to long established case law. All other pleadings filed prior to the date of this Order shall be unsealed and available to the public, except for the pleadings explicitly mentioned in this paragraph. Future pleadings and filings that are to be confidential shall comply with Court rules. Further, the Court has consulted with the Clerk of the Carroll Circuit Court about the impact of this Order on her office and staff, and the public interest in the pleadings which are being made available. As hundreds of pages of documents are being unsealed, this may create obstacles to the Clerk and the public. To ease the burden on the Clerk of the Court, and to ensure accessibility, the Court will make copies of the now public pleadings available at allensuperiorcourt.us/Delphi. John McGauley, Allen Superior Court, Court Executive has created this page on the Court's website to make these pleadings easily accessible to the public, the media, and the parties. DELPHI, Ind. (Scripps News Indianapolis) — The judge in the Delphi murders case will not order suspect Richard Allen to be moved to another facility, stating he’s being treated “more favorably than other inmates housed at the Westville Correctional Facility.”

Special Judge Fran Gull says the decision on whether or not Allen will be moved to another facility will be left up to the DOC.
