would any one of us who has posted on this case anywere, attended the hearing be disqualified as juror? i can not imagine how many of us would be.

Can't imagine a defense attorney wanting any of us on the jury, or the SA either, for that matter. It may not matter for a different case but this one I don't see them picking any of us here. JMO
 
Didn't Mr. Jordan get asked about this when he was interviewed about his being on W/S, what other sites etc.? IIRC he gave them the various usernames he had here since he joined. Just by reading someone's posts you can tell a lot about the person, but clearly their opinion on this case would be obvious. We would be disqualified straight away if called to duty to be on the jury. Joy or the author of that O'Town's finest letter would stand a better chance.
 
I first learned of what a complex process jury selection can be from the OJ trial. I wonder if it will be as complex and drawn out in this case ?

I think the process of jury selection in the Casey Anthony trial will be even more complex and drawn out than the OJ trial. This is a death penalty case and I'm sure there will be a lot of questions pertaining to the prospective juror's view of the death penalty. I can see at least a page if not more, devoted to questions about the death penalty.

Jury selection will be very interesting! The prosecution is going to want mothers and grandmothers on the jury, whereas the defense is probably going to be looking for single men with no children.

Although I did not agree with the verdict in the OJ case.I have
to say they were a group of good attorneys,and OJ PAID for
his own defense,so he was able to get the best. They were
a dream team.

However,this group of atty's that ICA wants to have and
the people of Florida are paying for,IMHO remind me of the
3 Stooges. They are unprepared,misspeak,Mason constantly
mumbles (can't understand the man) Baez does not have
a clue,:waitasec: and A.Lyon I don't know where to begin.

And how would that work? Anyone saying they would refuse to convict for death would be disqualified because it is a death penalty case? So can defense ask to have someone sit on the jury who admits they would refuse to convict???

I also believe that no real time transcription of voir dire is possible to protect the jurors identity.

We all know how certain folks on the DT like to drag reputations around like garbage in a trunk.

I believe that any prospective juror would be dismissed if they expressed opposition to the death penalty. They're usually asked that question pretty quickly. No, the defense wouldn't be allowed to request such a person. That would pretty much ensure a mistrial, I would think.

The lecture she gave regarding voir dire is nothing short of facinating. I posted the links to these lectures in the AL thread but I don't know how many people actually took time to listen to them. They are VERY interesting. They give an insight to her methods. One thing I found of particular interest......she discussed that some voir dire interviews were conducted in private and some were in the company of others. She used the "explanation" that she was running around between the interviews as a way to get transcripts of the interviews. Then she found ONE comment that she could use to personally identify with the juror. What I have a hard time getting past...is her reference to "the stupid jury". All this can be found in those lectures.

An aside. I recall Judge Perry commenting, when CM asked about the jury questionaire, something along the lines of....in my experience they usually change their answers by the time you get to them.

I find it interesting that this voir dire was the one they proposed for the FRAUD trial.

I plan to do more Voir Dire research tonight.

This is an outstanding doc. It also goes into what questions the Judges DON'T like to see asked and it discusses questions in a DP case.
 
Since you are required to show up for jury duty are you also required to answer these questions? What happens if you refuse to answer some of them?

The Judge has to approve of the Juror Questionaire. HHJP has already made his feelings on exhaustive questions known...he thinks they are a waste.


I would tend to beleive that the questionaire will be reigned in quite a bit. Check out the above link.
 
That is way too much information in one place to entrust to anyone....I probably would have issue with this questionaire.

Yes that is absurd. I can understand getting some basic info but is the system really supposed to allow handicapping on that level? You get a jury of your peers. Get their name/address/criminal history/mental health info if necessary and that should be it. It should be random and close to a true cross section of the community imo.

Very interesting apps! I wonder about the legal ethics involved here. Of course, this is a situation where technology is outpacing the legal response.

For example, would it be unethical for the SA to use "Jury Tracker" (or some similar software) on Casey and analyze her facial expressions? And, even if deemed ethical, I wonder about the constitutional concerns... Would it violate her 5th amendment rights (against self-incrimination)? 6th amendment (against covert state questioning)? 4th amendment rights(against illegal searches and seizures)?

Interesting indeed. It reminds me of a case I read about "thermal imaging" equipment that LE was using (from the street) to detect grow lamps in drug houses. That was another situation where technology outpaced the law's ability to handle it. However, the law caught up with it eventually and deemed it to be unconstitutional under the 4th amendment.
