AJ asking about pieces of glass found on bumper during Harnett's search. The car was towed to Canton PD from Dighton before Harnett examined it.AJ: according to your notes the glass pieces would have traveled 60 miles in a snowstorm before you saw it?He asks the same question about the hair."the hair would have made the same 60 mile roundtrip in a blizzard?"

@FallRiverReport

Jackson is essentially saying that there is no chain of custody documentation of the evidence Hartnett tested prior to her getting it on March 14th.

Jackson is finished with Hartnett and Lally is back to ask some questions.
After the misinformation about the belt and the sneaker, I wasn't sure if it was really true that the shirt was in Proctor's car for a month.

But based on this testimony that the evidence wasn't given to the forensic tech until 6 weeks later it sure seems like it's possible.

Jackson is up

Jackson establishing that her visit to Canton HQ on Feb 1, not Feb 2.
Jackson apologizes for his loud voice, says he’s not yelling. Says it’s not his normal speaking voice.

Jackson asking who was in charge.
-MST ProctorJackson asking what she was looking for, because she was told it was a motor vehicle pedestrian incident.
-Harnett says she does not draw conclusions.
Jackson says that was my next question.

Jackson establishes that she collects info & data, doesn’t draw conclusions.
Jackson asks if she was shown a picture of the injuries to OKeefe’s arm.
-no, not before Feb 1
Jackson putting the picture of OKeefe’s arm on the screen.
Jackson asking what she examined on the vehicle.

She examined every area but the roof.
All human tissue testing came back negative.
Now to the red Solo cups.
She noted she collected black brown substance from cups.
Did you label them!?
-no

Did you take samples from every cup?
-no, just one
How did you choose?
- I don’t know. I was told they were taken from the same stain.
If they were from multiple stains you wouldn’t know.
-correct

Two swabs were taken from cup.
Was DNA testing done?
-no
So we wouldn’t know if there were multiple DNA contributors.
-correct.
Most of the jurors wrote in their notebooks

Was the SUV just off the showroom floor?
- I’m not qualified to answer.
There was normal wear and tear?
- the outside was in good condition Harnett is resisting classification of Karen’s car as not brand new.

Jackson now asking where the swab was taken from the taillight.
Unlike some other prosecution witnesses, Harnett, so far, has been almost equally transparent in her answers with defense as with prosecution. IMO

Jackson asking about touch DNA.
Harnett says we can’t know how the DNA got there.Harnett also asks regularly to look at her notes, seems more familiar with her reports than others. If she can’t find something, she has a dialogue with Jackson.

Jackson trying to determine how many pieces of glass were collected.Harnett can’t find the number in the report, says she photographed them.
Jackson puts the photo up the car.

Asks Harnett to point to the pieces of glass.
They were not embedded in bumper.
-correct, they are just sitting on there

Do you know where Dighton is?
-I’m familiar with it
The car was involved in a Canton incident, towed from Dighton
- I don’t know how far Dighton is from Canton
The car was driven and towed 30 miles in a snowstorm. And you recovered the glass sitting on the bumper?

- I don’t remember the details of the storm, or how far Dighton is from Canton. But yes
Did the hair have to make the 60 mile round trip on the storm & being towed?

Harnett says she doesn’t know what happened to the vehicle before she collected evidence.
Jackson gives Harnett 4 photos.
She confirms them, 2 are zoomed photos of the images.

Up on the screen. The hair looks like a backward C?
- I agree
Does it look to you between the first & second photos that the hair has moved!
- I don’t necessarily agree with that. I can’t tell by the photo.

If you look at the zoomed in photos, does it look that the hair has moved - little bit?
- I just can’t tell from the photos.
Jackson put OKeefe’s shirt on the screen.
You said you took 2 swabs.
How did you take the swabs, were they all 9, how did you do that?

-swabbed all areas with 2 swabs.
Did you receive any training about keratin DNA?
-no
Do you know what that is?
-no

You indicated in your note you recovered debris from t shirt & sweatshirt.
She refers to her notes, yes.
You took scrapings from both shirts.
-yes
So you don’t know if it’s a combination, or came from one?
-correct

You didn’t mark or photograph the debris?
-correct
The shirts came in one evidence bag?
-yes they did

Jackson shows Harnett a photo. She confirms the bag as the evidence bag that contained the shirts.Collected by Trooper Proctor, collected 1/29.
Jackson puts it on the screen.
Shows they were collected & bagged together.

You have no idea the journey those items made before arriving in your lab.
You don’t know where the debris came from.
-correct
Were you aware they were in the floor of the ambulance?
-I don’t have any knowledge of that.
Or hospital floor?
-I don’t have knowledge of that.

Jackson asking about cross contamination.
Who had the evidence bag?
-Trooper Proctor

Jackson is trying to establish what items were submitted to her when.Harnett corrects him and explains.
Jackson is trying to establish what evidence was submitted in March.Harnett is reviewing the report

Harnett looking at log.
Plastic pieces submitted 3/1
A piece submitted 3/12
Another plastic piece, another, another, and another.
- yes that’s correct
And the dates of the shirts.

Before you received all the items, except what you collected, were submitted after 3/14 by Proctor.
Based on the chain of custody log, can you tell us of the shirts & plastic were stored in the same bag?
- I don’t have any knowledge of that

Jackson emphasizes the importance of the chain of evidence & documentation.Jackson is done.

Lally is up.
Asking again where the swab of the car was taken.
Asking what the temp in the garage was?
- no recollection
Was there snow or ice on the car
-no

Lally done

@SueNBCBoston

There's blood on the back of his sweatshirt, sort of watered down looking (for lack of a better term) in several areas. But when they take close up shots of the puncture holes on the arm of his sweatshirt, there's no blood at all. Nothing.
I don't get what you are asking then... so they splashed his blood on the body of his shirt and washed the rest? You followed your comment up by asking if they washed it.

@FallRiverReport

Ashley is running down a list of debris that she was able to review.

Juror #1 who has now moved all the way to the end, has actually been taking notes while looking at the witness and not looking at her notebook.

Juror #4 has taken to lingering at looking at the witness after she has finished speaking. Trademark.
