Robert Leroy Wilson is accused of handcuffing and beating his girlfriend's 9-year-old son for eating a piece of birthday cake without permission. The boy later died. Wilson was charged with first-degree assault and child abuse. Other charges are pending.

Oriana Garcia, 26, and Jacob Barajas, 23, have been charged with second-degree murder and child abuse in the death of Garcia's son, Jack Kirby Garcia, Hagerstown Police Capt. Paul Kifer said Monday in a news release.

A Maryland woman has pleaded guilty to first-degree child abuse in the beating death of her 9-year-old son over a missing piece of birthday cake.
Prosecutors agreed to drop a second-degree murder charge and seek a sentence of no more than 20 years for 27-year-old Oriana Garcia, who appeared Wednesday in a Hagerstown courtroom.
Her boyfriend Robert Wilson is serving 30 years for second-degree murder, and her brother Jacob Barajas is awaiting sentencing for first-degree child abuse.
One year to the day after her former boyfriend was sentenced to 30 years in prison for the fatal "birthday cake" beating of her son, Jack Garcia, Oriana Iris Garcia was sentenced Friday in Washington County Circuit Court to 25 years in prison for her role in the 9-year-old boy's death.
In imposing the sentence, Circuit Judge M. Kenneth Long Jr. exceeded the prosecution's recommendation of 20 years of incarceration.
"A mother's duty, first and foremost, is to take care of her children," a duty which she had failed, Long told Garcia.
The case and the sentence should serve as a reminder to others, the judge said.
"Some other child might be saved by a mother standing up to her responsibilities," Long said.
