Since JB is an Officer of the Court.. shouldn't he be held to a much higher standard than your average attorney?

I hope HHJP is taking notes of JB's transgressions and will address them in due time. JB, IMO, is not setting a very good example of how an Officer of the Court should behave.

Aren't all attorneys officers of the court?
 
IIRC during the last interview that G&C gave to GMA, did CA not state that she was also able to sneak a Mothers Day card to ICA after a court hearing?

It almost seems to me as thought G&C are doing anything they can (without filing a bar complaint themselves) to get JB off this case, I can say from reading there letters it does not seem that they are not fond of him at all, and if they believe that JB is the one that is keeping them from seeing and corresponding with ICA then they may think that by him getting kicked off they will then be able to have free access to there daughter...IMO ICA does not want to see to correspond with her parents but at this point I don't see that they would be able to put that on her, heck in there eyes she does no wrong, so there is no way that it would be ICA decision to keep them away.

Not that I know of. Not on this particular issue. (there have been other FL Bar Complaints against JB, on other issues)
Usually when a Bar Complaint is filed, it is NOT made public. It is kept confidential until the investigation is completed, and the results are made public.

I'm more saying the ones that have been filed in the past and were deemed unfounded or whatever. He had more than one complaint in the recent past, one from the judge himself. They were useless- he has been repeatedly allowed to keep up this type of behavior. This is just the recent charge. laws :crazy:

Arent all lawyers officers of the court? For some reason I always thought they were..

I guess it comes down to the specifically ordered rules of the Florida Bar, and if any complaint shows evidence that one of the FL Bar rules was violated, and also comes down to what evidence there is to prove the violation. Maybe the past Bar complaints just did not have enough evidence to support a finding that a FL Bar rule was broken?

Yes. IMO Cindy also committed a third degree felony when she gave a card to the Inmate, in the courthouse, during a recess in the Hearing. Baez had nothing to do with that transaction apparently. I believe the guards in control of the Inmate at that time, should have reported what Cindy did.

According to the Inmate, in her written letters to fellow Inmate Robyn, Cindy and Conway HAVE filed a Bar Complaint against Baez, on the issue of how the defense is being funded. Apparently the FL Bar found that no FL Bar rule was violated, as a result of that Bar complaint being filed.
 
In my lay opinion, I can definitely envision grounds for appeal by the Inmate if/when she is convicted.
Necessitating a RE-trial. I would think a delay now, before trial starts would be better than a RE-do.
If this "problem" is not addressed now, and resolved - it cannot be overlooked.
The Inmate, with the support of her parents, can argue that it was public knowledge that the attorney representing the Inmate was repeatedly committing a third degree felony, and nothing was done about it. She can say that she was not adequately represented by this particular attorney. She can argue that she relied upon him and his knowledge of the law.
I foresee all kinds of landmines resulting from this issue, if left unresolved.

If the rules in the Inmate Handbook do not really matter, pertaining to contraband, why does the Handbook say it is a third degree felony, punishable by $ 5,000 or 5 years in prison? Which rules do they "really" mean to enforce?

The Jail rule and the Florida law do not say that it is a third degree felony, ONLY if the content of the letters introduced as contraband was a "security risk". The law is that NO contraband, written communication of any kind is allowed (and for good reason).
 
Not sure if this has been mentioned yet, but after JBs whine and cheese fest yesterday, HHJP clearly and precisely stated it was not in the courts jurisdiction to do anything about what happens in the jail.

Now how quick will either HHJP or the SAO shoot over a formal complaint to the jail about ICAs and JBs infractions in violation jail rules and procedures.

The card should have been immediately taken from ICA by the guard. If CA passed the card through a guard, then the guard broke the law by giving ICA the card. This whole shennanigans just makes me sick. My ex was in jail/prison most of our brief time together. Let me tell you...if I had tried to give him a card or whatever, oh you can bet it would have been taken immediately, he would have never seen it again, I wouldn't have either and I'd be warned or not allowed in court or visitation again. The A's and Baez make me sick. Who do they think they are???

I have a sneaking suspicion that this case will be JB's last rodeo.

If you watch the tape, the card is given to the guard, the guard leaves (may be checking to see if she can give KC the card with the jail authorities) the guard returns and hands the card over. JB could have given it to KC in a file folder just as easily as she was sitting at the table. I don't think it was a big deal. If so the judge would have corrected those involved and we may never hear about it. jmo

Just this week, the media reported that an internal investigation resulted in the termination of the female guard who helped KC pass letters back and forth in jail. If I am not mistaken, this was the SECOND incident of a guard being fired over a similar infraction (wasn't there an incident in the beginning...or was guard just transferred?)

Now we have this THIRD incident (involving same inmate)....makes me wonder if maybe OC may need to do a much broader internal investigation into all their guards....

How many other prisoners are being faciliated in "receiving" items while incarcerated, and WHAT is going in and out of that jail?????!!!!!
 
I believe the jailer was transferred or suspended pending an investigation. Firing her was the end result. jmo

...and according to an article that AWC posted in the media thread, this guard was asked to pass along JB's business card to Robyn A. I hadn't read THAT before? Wow..I can't believe this.
