1/4/21 Update: Defense counsel noted that evidence review at the Criminal Lab occurred; defense counsel addressed some discovery that has not been provided. Court directed defense counsel to file a discovery motion no later than 1/7/21. State has 1 week to respond. Status hearing set regarding the discovery motion; discussion ensued regarding the logistics of the 2/1/21 evidentiary hearing. Defense counsel invoked the Rule of Exclusion for this hearing. Court directed the State to file the State's notice of witnesses no later than 1/6/21. Defense counsel to file the defense's notice of witnesses within 30 days thereafter. Court advised counsel that any hallmark objections can be presented during the evidentiary hearing since it is not before a jury. Defense counsel advised the Court that the evidence viewing with inmates at the WCJ via Zoom has been suspended & additional evidence viewing will need to occur in this case prior to the evidentiary hearing. Court advised counsel that the court would look into this situation. Next evidentiary hearing on 2/22/21.
