I really liked Mr Parked when George was testifying, asking good questions and making me question what I had thought to be the truth. Sure, that changed again after AC's cross, I didn't find George credible at all.

Anyway, I looked differently at Mr Parker after that and I was a bit on edge thinking he will be doing the closing statements. I am behind, as usual, but so far he is missing something from his delivery and the arguments he makes are not convincing.
Boy am I happy I was worried for nothing. So far.. :)

O/T tidbit of news - the largest volcano in the world is erupting on the Big Island. Mauna Loa has been silent since 1984 and it began erupting Sunday night. I'm not on the big island, but I hope to fly over to see it soon.
 
The world according to Parker. Nothing he has said so far changes the fact that GW helped prepare, was there, had a weapon in his hand, helped cover up and is guilty!!!!!
According to the realm of AC, (ramble, uhm, right, JESUS, blah, blah, blah,) he has at least three more hours to hit his stride.

Why am I feeling like deliberations will be quick?
 

On Jake: "I think he's psychotic ... he's a sick man and I don't think you can believe him." Also says Angela is just as bad - "that woman has problems too." Didn't do anything to confirm suspicion of sexual abuse. "They're liars, they're con artists, they're thieves”

Angela is "getting out of prison with the state's permission." Saying she pulled another con with her deal - getting all 8 aggravated murder charges dismissed "she's not being held accountable”

Parker: Angela only bought two pairs of shoes - not three. That's because Jake and Billy planned it.

Talking about confirmation bias. "They can't give it up" and only look for evidence that confirm their theory.

"Jake is a disturbed young man and vastly different than George." Parker acknowledges George isn't perfect and has flaws but he's not at all like Jake.

I overheard this part of Parker's argument and my conclusion was that he's still unable to refute the fact that GW4 was present when these discussions took place. That's the basis of the Conspiracy charge - the fact that GW4 was part of these discussions and plans and he did nothing to stop it. He went along with it all and helped prepare, implement and cover up.

Good morning from Pike County Wagner murder trial. Defense starts early with its closing arguments, then rebuttal by prosecution. Jury instructions will take awhile too - so unclear whether the jury will get case today or tomorrow.

Parker starts by thanking jury - and says "I'm not going to go as long as you might expect." Canepa went 4.5 hours yesterday. Asks jury that if he offended them, take it out on him not his client.

"You are the best of Pike County ... you stand between the power of the government and George Wagner." "They've overreached when it comes to George.”

Parker: state painted with a very broad brush. Days went by when we didn't hear George's name.

Parker: There were times I thought I was in divorce court or domestic court - this case is not about custody. Points out the affidavit from BCI of May 2018 used to get wiretaps. Said they don't have enough evidence to convict.

On Jake Wagner: "They want you to think he had a religious awakening" - it wasn't that. Why would state make such a deal for Jake Wagner ... says Jake is what the death penalty is made for

On Jake and Angela: What they said is just words and can't be proven or disproven.

Brings up timing of last activity of victims on their phones from phone records. Says "it doesn't add up" with the timeline Jake gave from the stand.

Parker accuses Jake of killing them all again as he did when Jake was on the stand. Says all the driving around and leaving the truck behind and using Chris Sr's truck doesn't make sense.

On to the custody motive - "have you ever heard of such a thing? No. ... It doesn't make sense.”

"Reason and experience teaches us people don't kill other people over custody.”

Running through how the plot came about. How Angela was concerned over possible sexual abuse of Jake's daughter. Then Billy says they have to kill them. Jake says no initially then says "I'm in" ... It's Jake and Billy - where is George in all this? Parker asks

Accuses Jake of shooting and killing Kenneth - no way he could have seen a muzzle flash like he testifies.

Parker on Jake's story on what happened at Chris Sr trailer and night of the murders "This is fantasy, this is part of Jake's fantasy.”

Why is George sitting on cutout away from Kenneth's trailer? He's not even there at that scene according to Jake

On Jake: "He's a liar. He's a cold blooded executioner.”

Parker: George testified he confronted Jake after BCI interviews from Montana border and asked if he had anything to do with it. Why not hear the interview from George at the border?

Parker: Did they ask Jake if George was there when Jake bought the murder weapon at the gun show? No. Do they have any evidence against George? No ... nothing except testimony of "watch my language" brother and his mother, who drug her own mother into this

To say George wasn't friends with Frankie is misstating the situation. Just drifted apart after they started having kids and when George got married.

Parker: I want to point out how hard it was for George to take the stand given his background.

"He was brutally honest with you ... he did it for himself obviously but he did it for his son." Says Jake and Angela have destroyed this man's life. His son is all he has.

Parker reads from poem from 1800s: before you judge a man "remember that there but for the grace of God go I ... remember to walk a mile in his mocassins." Going through pictures and exhibits he wants jury to remember. Says he's almost done but asks for morning break

It's really fascinating and alarming to know what mother nature can do. So far no homes/lives are at risk with where the eruption is occurring.

Did they say if jury instructions would begin right after closing or will that be tomorrow? Seems like the instructions would be longer also.

Eventually Jake says he's in w/ Billy's plan. "Do you hear George’s name anywhere here? No. Do you hear anything about a family meeting to discuss killing these people? No.”

CLOSING ARGUMENTS: Parker calls Jake Wagner "a sick man." Says jury shouldn't trust his testimony. "Angela isn't any better.”

Kenneth was one - Jake testified he saw a muzzle flash, that Billy killed him. Parker: "No way he saw that flash unless he was standing there with the gun shooting Ken in the eye."

CLOSING ARGUMENTS: Parker says it is "significant" that Jake's proffer led them to the murder weapons. "They never would have found them - but that’s his conduct. He verified his conduct.”

CLOSING ARGUMENTS: Parker tells jury Jake originally wanted to make the killings look like a murder-suicide - mentions strangling a pregnant Hanna May. But he says Billy said no. Parker describes Jake's testimony about what happened at Chris Sr's as a "fantasy." Doesn't add up.

CLOSING ARGUMENTS: Parker is poking holes in Jake's testimony about what happened inside Dana's house. He said he shot Hanna May in the forehead, but she was hit in back of head. "He was standing right beside her ... he's a liar and an executioner.”

CLOSING ARGUMENTS: Reason for showing that is to discuss George's friendship with Frankie. Parker counters state's claim that they weren't actually that close. Parker says they drifted apart as they got married and had kids.

CLOSING ARGUMENTS: Parker says George "broke every rule his father taught him by getting up here and telling the truth. Says "He did it for himself quite obviously but he did it for his son. Jake and Angela have destroyed this man’s life - and his son’s life.”

CLOSING ARGUMENTS: Parker says George "didn’t kill anybody and he didn’t go along because it didn’t make any sense."
He reads the poem "Judge Softly" - and asks the jury to 'walk in his moccasins' when judging the evidence in this case.

CLOSING ARGUMENTS: Court is taking a short morning break. Parker will finish shortly. Prosecutor Andy WIlson will handle state's rebuttal afterward.
