If I were an attorney, I would hesitate to hire someone who made such an overt and enthusiastic display of their personal allegiance to the hiring party. It would make me question the extent to which they could be impartial while looking at the evidence, and therefore the reliability of their findings. Or rather, whether their inevitably biased (paid for) opinion might too biased - tenuous and easily refuted. There would also be the risk of seepage on the stand, jeopardizing the credibility of their testimony. For instance, as in Laviolette's constant unspoken communication with the defense table.

This would be a concern regardless of their field of expertise.

I would rather play safe - or as safe as possible - and opt for an expert who appeared, at least, to be objective, in the hope that they'd be adequately impartial in their analyses as well, resulting in more reliable testimony.

So, at the very least, displaying his feelings doesn't seem like the wisest move on Neumeister's part, professionally speaking.

One wonders how many of those 'pornographic' images relate to BN's handshake fetish.
 
I am convinced she had his passwords till the end. She was too quick to admit it to Flores. And yes, her computer was fine then. I too think she knows someone with computer hacking skills.

Darryl worked at the Ventana Inn & Spa, in Big Sur, where Arias was a server. According to a Matthew Millea who was the Executive Chef there, he was Restaurant Manager and then Food & Beverage Director, then resigned that position and was a server for a short while before quitting altogether.

According to Matthew Millea, Arias got away with all sorts of nonsense because of her relationship with Darryl. There's a post by him with more detail on that, just over halfway down this page:

He hired Jodi at Ventana Inn to be a wait staff. Becomes murky after that when they bought the house he had no job. Jodi worked at Pizza Kitchen maybe some other job? Moved to be close to son in 12/2007.

She also made sure to let Flores know she had been in the office the day of the murder. I never questioned the pictures and sex upstairs in the bed. However, the downstairs/office/because Travis was angry so I had to calm him down sex never rang true. But was she regaling Flores with an office sex scene to cover why her DNA or fingerprints were on the computer or desk area? Idk

All paid witnesses will be cross-examined on bias. Some are more affected than others by being paid, of course.

Can Juan ask BN how much he's being paid since it's seperate sort of (legal term, lol) from JA's trial? That is an interesting answer I'd like to hear as an AZ taxpayer. Not sure if he asked that yesterday. tia

I'm with Hope on this one. It is the tempest in a teapot.

As for the end being near, until JSS puts a choke chain on Nurmi and tugs it from time to time, I think we will see these kinds of motions continue up until the day a verdict is rendered or heaven forbid, the trial comes screeching to a halt.

This whole effort is bogus. Go back to the original motion that started this all, the one filed on November 10. In it, the defense says that file deletion was done with such a level of success that it was years before it was uncovered. Yet Neumeister testified the other day that the *advertiser censored* on the laptop was not just the elephant in the room, it was an aircraft carrier. This is despite experts from opposing counsel both having examined forensic copies of the hard drive and finding nothing.

Beth Karas has an excellent, detailed report of the notes she took during the evidentiary hearing on this matter. Her notes clarify that the earliest mention of *advertiser censored* on the laptop dated back to September 2007.

To me, the biggest unresolved issue in this is why Melendez testified that there was no virus found on the computer and this is important in that it relates to possible perjury or the suborning of perjury by the prosecution. It may be that there was now active virus on the forensic copy, and thus the testimony given. We will have to wait and see. In any event, this does not seem to rise to the level of requiring a mistrial being declared, as it is such a far stretch to consider it exculpatory or that it would have impacted the guilty verdict. Arias said on the witness stand that Travis attacked her when she dropped his camera and she had to use self defense. There was no story of computer *advertiser censored* or computer virus in her version of events.

Gawd, can we just get this over? Can you imagine if every defendant went to these extremes during trial?

Three months after Travis and Jodi broke up and Jodi moved to Mesa.

Yes, I'm keeping track of all of these "experts" with slippery degrees. This guys pay will really bother me even more though. He has no degree like some of the others! Type computer expert into google and ebbybody is one. lol

On YouTube there are videos claiming prosecution and police tainted evidence. I wonder who is the group making them. I wonder if her family is spending her appeal money on the videos. What is the National Center for Due Process ?
When cmja is led into her new home no one can say she didn't have her day in court. These people can't possibly think this will make a difference.
In my opinion cmja and all her followers make Juan more determined to work harder to put her where she should be. These videos are disgusting.
 
Is it coincidental that BN is allowed to bring in his "eye picture", that is highly subjective, and then "finds" all this *advertiser censored* on a computer, when he doesn't advertise as a computer forensics expert, gets Tony's name into the mix to blame it on his tech, and can thereby state his "eye pic" was a part of a high profile case?

Bet he leaves out how his"eye pic" was a laughing stock tho

Says a lot about him that he thought his time was best spent trying to exonerate a Blob - earned him points with blobs everywhere, though.
 
I spent a good part of yesterday just thinking about "B's" testiphony.

This is a hearing about the computers. It is not for the jury to decide the outcome. The "trier of fact" here is JSS.

Knowing this, how can the defense set up this clown show? They are there to convince JSS that the computer was knowingly and maliciously tampered with.

What do they do? They take this B person and coach him to be extremely obnoxious and antagonistic (or it's just the way he is). He says he didn't bother to investigate the prosecution's drive since he "knew," without even looking at it, that it was knowingly and maliciously tampered with. He just uses his own "professionals" to make a copy of some copy with freeware. He comes up with hundreds of thousands of *advertiser censored* hits.

When asked to provide the evidence of it, he insists he's slammed with work and can't do so until next Wednesday.

My questions for all you who know so much more than I is this: Do you believe that JSS is buying into this garbage? Why is she allowing this witness to behave so outrageously on the stand? Does the defense believe they have the judge in their pocket because she's not reined them in during this interminable trial? Or, is it that JA has instructed this "expert" to behave in this way?

If I remember correctly he lied on the stand about the monthly mortgage being $1700-1800/mth, when in fact it was $2,800/mth. I think Juan brought out the actual amount on cross exam. I'll have to re watch Day 10 part 2.
