Although a state prosecutor association keeps no statistics on the number of South Dakota juveniles prosecuted as adults, the group’s executive director said teens involved in homicide cases often stand trial as adults. “It has been my experience, if it involves a serious charge such as murder, the person will be charged as an adult,” said Charles Schroyer, executive director of the South Dakota State’s Attorney Association.
Three weeks after a Mitchell girl was found dead in the trunk of a car, prosecutors are considering whether to try a second suspect as an adult.

A funeral has been scheduled for a slain Mitchell girl who died in November. The funeral for 16-year-old Jasmine Guevara will be at 11 a.m. Saturday at Holy Family Catholic Church, Mitchell. Visitation will be from 6 p.m. to 8 p.m. Friday, with a Scripture service at 7 p.m., also at the church.

A suspect in the murder of a Mitchell teenager has been indicted by a Hanson County Grand Jury. Alexander Salgado, 20, of Ft. Wayne, Indiana, has been indicted on one count of first degree murder, one count of felony murder and one count of first degree arson. Salgado is accused of killing 16-year-old Jasmine Guevara on November 10. A 15-year-old girl was also arrested for her role in the murder.

The remains of a burned out car and a body found inside it, discovered just south of Mitchell Tuesday night, are now in Pierre with officials for further investigation. Wednesday we learned a 16 year old Mitchell girl, Jasmine Guevara, is somehow connected to the burning car...but we don't know how.
Thursday we spoke with one of Guevara's friends about what they think happened to Jasmine. Some heavy thoughts are running through Amanda Nava's head as she plays with her daughter. Nava says, "I'm just hopin' it's not her." Nava is a friend of Jasmine Guevara's family. An autopsy will be performed on the body investigators removed from the car.

Mitchell Students Thank Police for Murder Arrest

Erin Fowkes is a counselor at Mitchell High School and has been working one on one with students who are taking the loss of Jasmine Guevara very tough. Students have been coming to Erin for help when they feel they need it and referring other students to her if they see someone struggling.
A part of the grieving process has been thanking those who helped catch the people responsible for this tragedy. Lt. Don Everson read a statement from the Mitchell Police Department saying thanks to the students.

Hanson County prosecutors say two people are responsible for the death of 16-year-old Jasmine Guevara, whose body was found in a burned out car in a rural area of the county on November 10th. One of them is this man, 20-year-old Alexander Salgado of Fort Wayne, Indiana. The second suspect is a 15-year-old girl identified in court papers as "M-D".
Action News has been working to determine if this girl will be tried as an adult for Jasmine Guevara's murder.
Hanson County States Attorney Jim Davies told Action News that determination will be made by a judge after a thorough review of the evidence, including a confession she gave to investigators. When that determination will be made, davies would not speculate.

The Attorney General's office says tonight the positivie ID is the result of DNA testing at a state forensic lab in Pierre. Amanda Walz Nava, a good friend of Jasmine's says, "It's kind of hard to explain you know you assume that it's her but you really don't know until it's been positively identified." Amanda prays that justice will be served to those involved in her death, "Obviously the guy is going to be charged as an adult because he's over 18 but I hope they charge the girl as an adult too because pretty much it was all her idea."

This man, Alexander Salgado, is in a Davison County courtroom this afternoon where he decided to stick with his current defense attorney. Today's hearing only lasted about fifteen minutes. The judge ruled on a few procedural issues. We can tell you Jasmine's family was in the courtroom and her mother was very emotional. Salgado is expected back in court on March 22nd.

It was an informational hearing where both sides were present and because Salgado is charged with a felony. He had to be there. During the hearing, the defense asked for police field notes that the state wants excluded. The judge said he would rule on the requests at a later date. The Hanson County State's Attorney also tells Action News they are still trying to determine whether a 15-year-old suspect also charged in the murder will be tried as an adult.

The hearing was not for Salgado, we're told it was a Juvenile Hearing, involving who we believe is the juvenile suspect also charged in Guevara's murder. Because it was a juvenile hearing.. it was not open to the public. Salgado is scheduled to be back in court later this month.

Hearing held in Guevara murder case
A judge heard arguments from both sides of the Jasmine Guevara murder case during a suppression hearing on Wednesday in Mitchell. Five witnesses involved in the investigation were questioned as part of the hearing. All were law enforcement officials.

Alexander Salgado was in court Wednesday for a pre-trial hearing for his involvement in the murder of 16 year old Jasmine Guevara. The big part of the hearing today dealt with the defense's motion to supress 16 newly admitted exhibits of evidence that stem from Salgado's questioning prior to arrest.
According to an police interview transcript Salgado says "That's the truth now take me right to jail." The defense claims that this is an indication that Salgado is requesting to impose his right to remain silent and that anything gathered or testimony given after that point should be thrown out.
As for the state, they argue that that is not a clear indication and Salgado continued to speak and freely gave his testimony. The judge will now take time to review the tapes, exhibits and attorney briefs. A written ruling is expected later next week.
As the five witnesses recounted their testimony, Alexander Salgado showed no emotion. The family members of Jasmine Guevara were clearly torn by having to relive that painful day.
