morning!

trying to catch up! after reading comments last night, i had to watched to the State's last witness. i had stopped watching b/c by that point i was just so fried i couldn't take anymore in.

The last witness (i'm bad for not being able to recall her name) completely supported Dr. DeMarte's testimony, and the icing on the cake was that she made wilmont look like a vindictive idiot. moreover, it was clear from her testimony--especially while Juan was questioning her--that she was not rehearsed in any way, and that for me significantly added to her credibility and showed she had no bias.

but damn, she schooled wilmont more than any other witness on the stand and it was a pleasure to watch and a great way for the state to rest its case.

if jury instructions are relatively short i'll likely miss the beginning of Juan's closing arguements. but hey, if i just tune into HLN, i probably won't miss a thing!
 
i don't see it this way. yes, she lied and was on record with the lies so they had to work with them. but the attorneys created this defense. they had to come up with arguments against the state's evidence. that's their job. it's NOT their job to find the truth. that's the job of the state.

to believe it's the defendant who provides every answer and the lawyers simply use that and nothing else isn't true. if it was, there would be no need to get the best defense attorney you can find----you'd just need someone to parrot what you say. do you really believe JW and KN buy her story and are just thinking 'she really didn't do this and was abused and had PTSD and is the true victim here?' i certainly don't believe that. defense attorneys defend guilty clients. it's STILL their job to try to get them off.

Everyone deserves a defense. They have to support her theory. They don't get to make one up on their own. The possibility that she is telling the truth is there. NO ONE WAS THERE BUT HER AND TRAVIS. IT is not like there is a video of the crime we still have to deduce what happened june 4. The state has the right story in my opinion but she needs to put forth a defense. This is not about fair or morals but setting up a defense for someone with one shot between her and death.

But this morning I woke up sad thinking about this. It's a given that I feel sadness for Travis and his family, but I feel sad for her too. She wasted her whole life in a fit of rage, a horrible horrible tantrum.

I don't see any victory here.

Regarding JA you are a better person than I am. I believe that JA has terrorized her entire family from a pre-teen till this very moment. I believe she has taken each and every opportunity to cause them grief, fear and unbelievable terror.

From JA's brothers and sisters to grandma they will have peace that knowing their tormentor, thief and family member who can, has and will murder is behind bars for her natural life whatever that may be.
 
Sorry to ask this, but what time does court start today? I thought it was 9:00am, but I saw Wild say 9:30. I do not want to miss a minute. TIA

9:30 a.m. Arizona time although jurors will be in by 9:15.
 
I have a confession to make!

My dishwasher is broken, and I didn't do my dishes last night, so I'm off to do them! I just wanted to stop in and say good morning.

While I take care of what I need to, My thoughts will be with Travis's families and friends as they are preparing themselves for Closing. I am standing with them in Spirit and knowing, that all truths are out there, and Justice For Travis is really really upon them.
My thoughts will be with Mr. Martinez as he draws up his sword, to prepare his final battle of Truth and Justice.
Then to the Jury, that through all the 'squibble, squabble' that they see the one truth, that Travis was murdered and it was pre-mediated.. they See the Sword of Truth in flames before them.

I'm with you all too, trying to get things done, so I can come back and hang out with you all later. Each Morning, I get a "spark" added to my day because of all of you.

Wonder what made the DF believe that Geffner was qualified to talk about the brain injury since he'd never done or been to an autopsy or that he would have more knowledge/experience than Horn. I'm sure the jurors wondered the same thing.
 
I only wish Judge Stephens would have had a few more marathon days, and less 4 hour court days for this trial and we would have been finished a lonnnnnnnnnnnnng time ago. I seriously cannot fathom why she handled yesterday as she did. Does a juror have a commitment after May 3???? Why the marathon on the VERY LAST DAY? Crazy
 
thank you....do you know when they pick the jurors? before closing arguments? after? before jury instructions? I am lost here....
Beth Karas said Arizona doesn't pick the final 12 until after the conclusion of closing arguments. That ensures that every prospective juror pays complete attention to what is said from start to finish. I like it.
 
I don't see how that's even possible. JA got on the stand and lied. The entire DT opening statement remains unproven. The defendant has admitted to the killing and yet a typo will hang the jury??
How can JA be believed because the ME failed to insert the word not in a lengthy report? Even if TA did lunge at her and say 'Kill you b*tch' while somehow not bleeding from a head wound, how does that justify her not running away to safety as opposed to hunting down a knife deadly enough to sever his throat?
And then there's the dozen or more defensive wounds to his hands and back which can't be explained away by the ME's omission of a single word.

Travis is still dead and JA still admitted to killing him in 3 different ways. It is possible to die of a head injury that leaves the membranes surrounding the brain intact and it happens everyday on highways all over the country.


Why do you suppose the prosecutor let a juror question bring out the dura mater question, instead of asking Dr. Horn that question himself in redirect? When that juror question was read, I immediately thought "GOOD QUESTION" ... then followed by why didn't Martinez ask his own witness to clarify that issue? Do you think it was intentional that Martinez let a juror bring that typo mistake out?

Judging by Wilmott's angry reaction, this one question totally destroyed the ground she thought she had gained with Dr. G's loooooooong testimony.
 
Watch it for a second time once you get through the first run. I came to the conclusion that he was there to avenge his friend ALV. He stubbornly refuses to answer questions from Juan while easily answering Willmott's, he actually mocks, laughs at and denigrates Dr. Demarte's merits as a Psychologist and her work on the case.

He then refutes the testimony of Dr. Horn and claims that there is no such thing as a "shock wave" created by the bullet and that the bullet would have to hit specific areas of the brain in order to do damage. Absolute garbage!

Once you see it a second time you'll see he is actually LYING about the 'floating profiles'--and that's just one example.

The judge who called him a "hired gun" was spot on.

I still can't believe the DT felt it was wise to have this psychologist testify about the ME's findings. Why not use another medical examiner for that?
 
I noticed that too, very red, I was wondering if at one point she was trying to hurt her fingers under the DT table to force out some real tears.

I think its stress and anger. Her circus is ending and closing arguments will reveal what we have seen all along: A man who was murdered while he was taking a shower. There are no more cards to play, no magical witness to save the day.

I was thinking about this Durmater (sp?) thing last night. If you recall, Wilmott was the one who first brought it up with Dr. G. When she was talking about it, I remember thinking that this sounded very "important" and like a "big deal," so I was thinking why didn't she ask Dr. Horn about it since she got multiple chances (at least 2) to ask him? This was before I knew Dr. Horn would be testifying a 3rd time. I was thinking to say that the membrane was left intact was a pretty big deal. Well, after Dr. Horn got off the stand...it seemed so strange that Wilmott NEVER ASKED HIM ABOUT IT. She had asked Geffner about something in Dr. Horn's report, but she didn't ask Dr. Horn even though it was his own report! I thought this was very strange, and made me suspicious.
During all this, Juan never said anything about what Wilmott had said. Then...as the very last juror question we got that DuraMater question...Dr. Horn looked at his report and said, oh sorry that was a typo. BINGO. Then I figured out why Wilmott had never asked Dr. Horn about it - 'cause she KNEW it was just a typo, but if she had asked it Dr. Horn would have confirmed it to the jury that it was a typo...and she wanted the jury to think that it was the truth and that the DuraMater was intact. She did not ever lead on during Dr. Geffner's questioning that she knew it was just a mistake, she lead on like it was accurate.
UGH, this just made me so mad...if I was the juror who asked that question I would seriously feel like Wilmott lied to me. I wonder if any other jurors felt this way, or thought about the reason why she never asked Dr. Horn directly when she had multiple chances to do so. To be fair, Martinez didn't clarify what she claimed, 'cause he probably didn't want to admit Dr. Horn made a mistake, so you could go either way...but the way Wilmott pushed it and pushed it with Geffner, and then turns around and essentially admits that she knew it was a typo/mistake...that was just low. She even asked Dr. Horn at the end "your report is accurate, right?", so the jurors would think that the DuraMater thing was accurate in it.
Again to be fair, Martinez has probably done some of the same things we just haven't caught it, but this one by Wilmott was actually caught by at least one juror.
Thanks for letting me know that it was at least acknowledged in some way during testimony. I thought the first mention of it was by the juror. Likely, as a previous poster (sorry, I can't remember who) noted, she was going to save this for the closing argument when there would be no more witnesses called to clarify.

I thought I would ask why I am all of a sudden getting an annoying window (with accompanying annoying sound!) with the yellow "caution triangle" with the exclamation point when I try to thanks someone?

It just started yesterday. I OFTEN get the "no response" thanks - where the thanks button disappears after I click it but my thanks actually doesn't show up. But this annoying window is just that....ANNOYING!!!

I imagine jurors' commitments or just the fear of losing jurors. It was a long day but not unreasonable. The jurors had plenty of time to eat and sleep well.
They should be well-rested and ready to go today.

(Respectfully snipped by me) One of my sons was shot in the thigh in a holdup at a pizza joint where he was working in his twenties. The pain was so intense, he immediately began screaming nonstop and nobody could shut him up. He vomited, he writhed, he swore, had a huge adrenalin jolt after which he went right into shock.

In the movies and in video games, people are shot and then just ignore it because they're so "tough" and they keep going with their reflexes and attention functioning the same as before they were shot.

In real life, you vomit, you pee, you can't hear anything, things seem like they are in slow motion, or you faint from fear. AND THAT WAS JUST A SHOT IN THE LEG from a small caliber bullet.

Incidentally, he has a small scar like a pencil from the entry wound and the exit wound scar out the other side of his leg is huge, like the size of an orange.

Most of us have never been shot, but those who have will verify that it is not a "you just keep going" experience.

Jodi does appear to have a different nose, however the present nose is still big, and her nostrils are animal like...

just yesterday I commented that she had an ugly nose...my husband say's she is not pretty, period.

I know those giant spider hands give me nightmares...yesterday her knuckles were red...

she is morphing into A Yates before our eyes....
