If the girl misrepresented herself to be of age, then why the searches by RS about age of consent? BTW she is now and apparently was age of consent according to GA law for sexual consent. She was 16 when it started and 17 now. But GA and Federal law state that the sending of photos pornigraphic in nature (ie sexually suggestive or in state of arousal) is crime til person is 18.

So if the defense tries to allege the girl lied and said she was of age, she didn't really lie. Our perp just forgot to consider the laws might differ in regard to taking, receiving or sending the pics.

The laws in GA boggle my mind. RH could have legally had sex with a 16 year old, but he can get in trouble if the same 16 year old texted him pictures of her breast. He can see her naked body in person, but it's illegal for him to have a picture of it! GA you make no sense!
 
Sadly it's not just Georgia. This applies to every state that has an age of consent under 18..which is most states!

I'm from GA and totally agree with you, but sadly we're part of the majority of states in this country with this issue. I believe there are around 39 states that the age of consent is under 18 (the federal age of whether or not something is child *advertiser censored*). So while I agree with your outrage, it's not just us!

DD who is 13 used it at 12 last year with her friends, but got rid of it since I was checking her chats.

Because of how the laws are, I am pretty sure it wouldn't help him even if she did claim she was of age.
And him not knowing the law doesn't absolve him of responsibility either.
 
I doubt anyone is in a big hurry to prosecute the girl, she could end up being a key witness in the case and will for sure be portrayed as the victim in his charges about her (if they are levied and not just a threat to pressure a plea). Kinda hard to prosecute her if you intend to hold her up as a victim.

But yeah, the laws in this whole area of law are one hot contradictory mess. MOO
 
Whether or not 'she lied about her age!' can be used as a defense depends on if the law in question requires intent (mens reas) or not. If it doesn't require intent (and I don't think Georgia does for statutory rape -- though with the age of consent being 16 in Georgia, this doesn't apply in this case, if they even did the act which who knows) then you can't claim that as an excuse. If a crime does require intent, then a person might be able to use 'she lied about her age' to avoid being found guilty. It'd likely come down to prevailing common sense. It's more likely a judge/jury will believe that a mature-looking 15-year-old lied about her age was believed, than to believe that an 11-year-old claimed to be 16 and the perpetrator completely believed her.

As for child *advertiser censored*, that's a federal charge (I think?) and I have no idea if it requires intent or not.

Technically, though, a 17-year-old with a seductively posed selfie on their phone is guilty of possessing child *advertiser censored*, even if it's just a picture of themselves.
 
It is important to note that an offender can be prosecuted under state child *advertiser censored* laws in addition to, or instead of, federal law

no dang it and it is really interfering with those trying to sleuth his online presence, lol. He had to be a member of some sort of online meet-up or dating or casual sex site somewhere but there are so many it's like looking for a needle in a haystack.

I wonder what the final count will be when it's all said and done?
 
Would be interesting to know if there was just the one minor or several and if he had a type. Not that it has anything to do with Cooper's murder what his taste in sexters was, just curiosity insofar as it might help those trying to psychoanalyse dude.
