Has she already told both lawyers what she has decided?

If so, does Oscar already know?

Sorry for the timing of this question but the text on web sleuths has suddenly got smaller. I have refreshed the page with no luck .
Any ideas anyone ? Have I reset something somehow ?

Have you tried pushing Ctrl+ ?

Roux does not look happy.
Oscar doesn't look happy.
Family doesn't look happy.
 
M... I don't agree that in this case there is no allegations..
 
Think she is going to agree. Not agreeing with defence opposal.
 
J:...her focus (Dr V) was on a GAD that may have affected the accused during the event...the acused, amongst other things was hypervigilant....

Judge then outlines what Dr V said about hypervigilance, and OP's escalating anxiety when he thought he heard a noise.
 
the defence says, at the time of the incident.. the accused was not suffering a criminal incapacity..

I however , do not agree.. the accused may not have raised the issue that he was criminally responsible at the time of the incident, but evidence clearly raised on his behalf cannot be ignored..

re Dr Vorster' evidence.


Voster compiled a comprehensive report.. how his social and professional life shaped his personality. her focus was on his diagnosis. which may have affected his conduct on feb 14. she repeated this under oath.

it is necessary to focus on incidents .. Vorster said, he is hypervigilnant, constantly looking around for any kind of threat.. when dealing with the incident. Mr P , believed he faced an intruder, and had , consequently, escalated levels of anxiety.. Counsel asked, re his vulnerability. his physical vulneravbility makes him more anxious.

Voster said , he has a long history of anxiety provoking incidents. these factors were all operating at the time of the offence, and would have been compounded by his physical disability.

Mr P is MORE likely to respond with a fight response rather than a flight response..

J: Dr V stated more than once that accused has an anxiety disorder.....when exposed to a threat Mr P is more likely to respond with a fight respone, rather than a flight response because of his physical vulnerability...
 
How ironic that their own defence witness is responsible for all this!! OP looking very intent.

It's kinda cool - we get to hear bits of the psych report we wouldn't normally be privy to.
 
Dadic again:

The fact that hardly any police arrived today, pretty much meant that the State knew the trial wasn't continuing.
