Hopefully she's just addressing one of the sentencing precedent's that Roux supplied and stating why she disagrees with that one in particular too. She said there were two that Roux had given that had valid points but dismissed others.
 
Saying Foster didn't know there was someone on the roof. OP knew there was someone in the cubicle.

One did know someone behind the door, one didn't.
One fired one shot, one fired four
one had aim to frighten away intruder, present case aim to shoot intruder
One case had opp to flee, present case opposite is tru, Intruder wld have had no room to escape
present case accused trained in firearms and intended to be a collector

The degree of negligence in this matter, sentence suggested by AV not appropriate.

The only similarity between the cases then is the post fact remorse. The facts are almost polar opposite. No way sentence can be the same.
 
Op used noise as a way of saying a intruder was there...judge used noise against him
 
SHe still has a few sheets on that stand! Come on! (Another who needs to pee!) I am still hoping for jail and think it is a possibility given her judgement so far.
