Woman accused in Guillen death case gets added lawyer as trial approaches

A federal judge recently ruled on two motions in the case of a Killeen woman who is accused of helping her boyfriend cover up the murder of Fort Hood soldier Vanessa Guillen last year.

Jury selection in the trial of Cecily Aguilar, 22, still is set to begin on March 8 in the courtroom of U.S. District Judge Alan D. Albright at the federal courthouse in Waco. She was being held without bond in the McLennan County Jail on Tuesday. Also, Horatio Aldredge, a federal public defender and law professor at the University of Texas, has joined Lewis B. Gainor on Aguilar’s defense team.

One of the two motions is unavailable for the public to view, along with the judge’s subsequent order. The motion, filed on Jan. 15, is “under seal” and the reason is unknown.
 
Tuesday, February 23rd:
*Re-Arraignment Hearing (@ 9am CT) - TX – Army Specialist PFC Vanessa Guillén (20) (last seen sometime between 11:30am & 12:30pm on April 22, 2020 in the parking lot of her 3rd Cavalry Regiment Engineer Squadron Headquarters. Keys to her car & her barracks room & her ID card and wallet were later found in the armory room where she had worked earlier in the day; reported missing April 23, 2020, Ft. Hood military base, remains were found by contractors working on a fence along the Leon River in Bell County on June 30, 2020 in 3 shallow graves & the remains were sealed in concrete in Belton; ID’d on July 6, 2020) - *Cecily Ann Aguilar (22) – (Robinson’s GF) – arrested (7/1/20), charged (7/2/20) & arraigned & indicted (7/14/20) with 1 count 2nd degree conspiracy to tamper with evidence with intent to impair a human corpse, to corruptly alter, destroy, mutilate or conceal an object, or attempts to do so, with the intent to impair the objects integrity or availability for use in a criminal case & 1 count conspiracy felony tampering with witness, victim or informant & 1 count felony tampering with witness, victim or informant. Plead not guilty. Held without bond.
A federal affidavit released on July 2, 2020 says Robinson beat Guillen, with a hammer & that her body was later dismembered & burned. If convicted, Aguilar could face up to 20 years in prison with a maximum fine of $250K.
Trial was set to begin on 11/30/20 with jury selection has been cancelled, and reset on 1/19/21 which was reset by Judge to 3/8/21 with jury selection.

12/28/20 Update: Supervisory Assistant Federal Public Defender Lewis Gainor filed a motion to continue was unopposed by the prosecution. Gainor asked the court for more time to complete his review of discovery & investigation in his motion. He asked for a continuance of at least 30 days. Gainor also filed a motion for a bill of particulars on 12/22/20. U.S. District Judge Alan Albright had not ruled on either motion as of Tuesday, 12/29/20. Aguilar pleaded not guilty to 1 count of conspiracy to tamper with evidence & 2 substantive counts of tampering with evidence. Aguilar faces up to 20 years in federal prison for each count upon. She was scheduled to be re-arraigned Jan. 5 followed by a trial on Jan. 19, 2021.
1/5/21 Update: Aguilar was set to be re-arraigned Tuesday, 1/5/21, and jury selection was set to start on 1/19/21. Her attorney asked Judge Alan D. Albright to reset the hearing, which the prosecution did not object to. Judge Albright reset the re-arraignment to 2/23/21 & jury selection to 3/8/21, in front of U.S. District Judge Alan D. Albright in the federal courthouse in Waco. He also extended the Plea Agreement deadline to February 15, 2021. Also U.S. District Judge Alan D. Albright ruled on motion to add Horatio Aldredge, a federal public defender & law professor to Aguilar's defense team.

I did have a link to the Judge's calendar - but the one you posted is more updated. I didn't have her on the one I had bookmarked. Looks like it changes every month.

So.... why? Plea deal?

Many places in Texas are cancelling trials again as they did in 2020 due to COVID and postponed until further notice. (We'll see if yesterday's announcement by the Governor to open 100% masks is followed in court system o_O) I just checked the page, and no updates since the screenshot above. I'll keep checking to see when the mentioned status conference is scheduled.

Thanks for that link to Aguilar @dixiegirl1035 - I just had the one for the Judge. :)

@Seattle1 has the best stuff and earlier, as @Seattle1 has PACER which most of us don't have access to unless s/he shares. Which shows much more than the free sites and can see more? Most of the case is sealed though.
