LAREDO, Tex. (KGNS) -The former Border Patrol agent accused of killing four women and kidnapping another is expected to appear in court on Monday.

Through social distancing and via Zoom, Judge Oscar Hale held the hearing at the 406th District Court.

According to the District Attorneys Office there are three motions attorneys were discussing, the first is the motion to determine admissibility of written oral statement.

The second is a motion for hearing if he voluntaries admission or confession whether written or oral and the third is a motion to suppress.

Laredo judge denies motion to suppress confession of alleged BP serial killer

July 14, 2020

A local judge has denied a motion to suppress in the case of the former Supervisory Border Patrol agent accused of fatally shooting four women and kidnapping another in Laredo during 2018.

According to online court records, 406th District Court Judge Oscar J. Hale Jr. signed an order on July 10 denying a motion filed by Juan David Ortiz’s attorney, Joel Perez, requesting to suppress the defendant's confession.

The order states that the court concluded that at the time when police initially approached Ortiz there existed reasonable suspicion for his detention.

“The court finds and concludes that sufficient probable cause was contained within the four corners of the affidavit in support of, and attached to, the search warrant issued on September 15, 2018 for the search of (Ortiz’s) residence and the search of (his) residence was therefore, valid,” the document states.

Hale scheduled a status hearing for Oct. 15 in the 406th District Court.

7/2/20: Prosecutors challenged the motions filed by calling Texas Dept. of Public Safety Trooper Abiel Obregon & Webb County Sheriff’s Office Captain of Criminal Investigations Federico Calderon to testify. Calderon testified Monday that Ortiz’s interview began shortly after 3 a.m. It took approximately 10 hours & ended around noon the next day. Calderon added that Ortiz was advised of his Miranda Rights & he never requested an attorney, never asked to terminate his interview. This was the beginning of Ortiz’s confession to authorities about the murders of Ramirez, Luera, Hernandez & Ortiz. 7/10/20 Update: Judge Oscar Hale: Motion to suppress confession-denied. Status hearing on 10/15/20. 10/15/20 Update: No motions were filed, and the attorneys agreed to set another status hearing for the second week in January. Judge O.J. Hale noted that in the past they had discussed that the trial could take place in late 2021, but the pandemic has delayed things. He did not set a trial date. Assistant District Attorney Joaquin Rodriguez said they have made all evidence available to the defense. But Ortiz’s attorney Raymond Fuchs said they still need a continuous recording of the defendant’s statement.

LAREDO, TX. (KGNS) - The former federal agent accused of killing multiple women in an alleged murder spree appeared in court for a status hearing.

On Thursday, the 406th District Court Judge OJ Hale, Jr. had a scheduled hearing for the capital murder case involving former Border Patrol agent Juan David Ortiz.

Ortiz’s attorneys and the state set another status hearing date for September 9th at 9:00 a.m. and discussed a potential trial in March 2022.
