Article was already posted, however, reposting it, because of "crickets" with this case... I've seen no mention of a scheduled preliminary hearing.

Brackin filed her initial argument under seal Dec. 22. The defense has two weeks to respond and a hearing will be scheduled by mid-January.

Until the dispute over the rest of Kouri’s writing is settled, the court won’t schedule a preliminary hearing or move on to jury selection. The murder trial is still months away, at least.

--Allegedly KR violated terms of her plea in abeyance for assault. These charges came after she attacked (y'all remember that?) her SIL when trying to stop KR from drilling into ER’s safe, which happened prior to his demise.

--Allegedly KR is to appear in court on March 12th, at 1:00 pm. This hearing is to show cause why the defendant’s plea in abeyance should not be terminated and a conviction entered.

So this hearing is NOT for her murder trial, correct? TIA! :) I can not access the article you posted...

didn't this happen just after his death, when SIL told her she needed to stop drilling into the safe because Kouri was not granted the property in his will?

Yes, agreed. Allegedly, KR hired a locksmith. SIL told her she needed to leave the safe alone (see nbc news linked article above), the state alleged in the filing, that KR became angry and punched her SIL in the face and neck.

It happened after ER's (correction to my post) demise.

Until the Court determines whether or not the content of the "Envelope" is 1) actually privileged information or 2) relevant to the case, I don't think the public will receive information on what is happening in the "closed hearing" that was initially expected to take place in December. JMO

10/16/23 Update: Prosecutors say Richins’ was writing instructions to her family on how to testify in court. Richins’ lawyers say she’s writing a “fictional book.” Either way, the prosecutors say they now want the whole manuscript — all 65 pages’ worth. Richins is currently in jail awaiting trial. Last month, jail officials found a paper that appeared to prosecutors to be telling her family members how they should testify in court. This week, prosecutors asked the court to compel Richins & her attorneys to turn over the rest of the so-called “Walk the Dog” document, which may contain another 60 to 65 pages. However, new court documents this week include a transcript of a phone call Richins made in jail to a family member explaining the controversy. In that transcript, Richins complains of unfair treatment both in how deputies obtained the Walk the Dog letter, and also in penalties for having it in her cell in the first place. She claims in the call she has had her phone calls limited to “voice only & only handwritten letters out, 90 days.” State files Statement of Relief Sought & Grounds re "Fictional Manuscript" Motion to compel Good Cause Disclosures by Margaret H. Olson filed on 10/12/23. Judge Richard Mrazik called a hearing that same day to sort through it all. He decided prosecutors won’t get extra time to respond to Lazaro’s motion to dismiss all charges. Instead, the first three motions—all related to the search of Kouri’s cell—will be handled at the 11/3/23 hearing already on the court’s calendar. Whether Lazaro has to hand over what Kouri gave her in the envelope the day of the search will be determined at a later date.
11/3/23 Update: The first Motion argued was the Defendant’s Motion to Dismiss Due to Prosecutorial Misconduct was DENIED. Judge Richard Mrazik is confident the court can ensure RIchins will receive a fair trial with extra precautions during jury selection, etc. The court is also denying the state’s motion to prevent Richins from speaking with her mom & brother. The judge says Richins has first amendment rights to correspond with who she pleases. Defendant’s Motion to Enforce Order & for Contempt Sanctions-DENIED. Judge Mrazik heard the State’s Motion to Compel Good Cause Disclosures where they want access to any non-privileged writings contained in an envelope found in the defendant’s jail cell, which are now in the possession of her attorneys. The state says that could be evidence, and it wants to see the documents. Lazaro said it’s privileged information, but after much discussion Nov. 3, she agreed to give a third-party attorney Kouri’s 60 additional pages & the other inmate’s letter. Prosecutors will select that attorney, and Mrazik will issue a strict order later about who is allowed to see the documents. He indicated he would prefer prosecutors not see what was in the envelope & the attorney they select to review it would act in their interest. The judge told both sides to meet & decide the best way to proceed before December. Then he’ll set up a closed hearing to see if the writings are, first, actually privileged and, second, relevant to the case. Defense attorney Skye Lazaro said she does anticipate filing for a change of venue. December’s hearing will address the schedule of the case going forward too, now that the defense’s request to dismiss the case was denied.
12/7/23 Update: Court appointed an independent representative for the State (Jami Brackin) to look inside the envelope at letter #2, and 60 pages of Fictional Manuscript, and Ordered the defense to comply with the following by the dates. The defense shall provide the Review Material to the State's Representative by noon 12/8/23. By 11:59pm on 12/22/23 the State's Representative shall file an opening memo arguing why good cause exists for Court to order production of the Review Materials. By 11:59pm on 1/5/24 the defense shall file under seal an opposition memo. By 11:59pm 1/12/24 the State's Representative shall file under seal any reply memo. The Court will determine whether to schedule a hearing.
12/29/23 Update: Jami Brackin, a former Summit County attorney known for her legislative & land-use expertise who now works as the deputy city attorney for St. George, filed a memorandum in support of the release of the contents on Friday. Brackin was selected as the state’s third-party representative earlier this month as ordered by the Third District Court. Under the court order, Brackin reviewed the material to argue why the defense should turn it over to the state. The filing was sealed to ensure prosecutors are unaware of the contents until the judge makes a ruling on whether it’s attorney-client privilege. The defense now has two weeks to file a response arguing why the envelope shouldn’t be public. Then, Brackin will be given until Jan. 12, 2024 to respond. The County Attorney’s Office is expected to ask the court to make a decision, which means a hearing could be scheduled.

In the early morning hours of March 4, 2022, Kouri Richins says she found her husband Eric unresponsive in their bed. She said his death was an accident, but a year later she was arrested and charged with murder. The circumstances surrounding Eric Richins' death are investigated in "The People v. Kouri Richins," an all-new "48 Hours" reported by contributor Natalie Morales and airing Saturday, Feb. 24, 2024, on CBS and streaming on Paramount+.

Kouri's family says she lost more than just the father of her three young sons and husband of nine years. She also lost a huge business deal worth millions.

As if their words should be taken at face value at this point! Their word means diddly squat to me after reading KR's "WALK THE DOG" letter addressed to her mother. You know the one... where she told her mother exactly -- word for word -- what she and her brother and her friends should say about her during TV interviews just like this one.

I guess they were hoping enough time had passed and we'd have forgotten all about that incriminating letter "fictional novel" by now.
