Judge is on the bench and on time. Defense raising concern about additional 70 pages of discovery sent from the state at 10:47 p.m. last night related to the Garmin GPS unit.

State says the data is still the same, but the digital forensic expert preparing for trial created this document. The expert wants to use them for reference today. Defense having expert review now. Judge with a large sigh.

We are underway here at the #RodgersTrial. Assistant Public Defender Rexford Darrow said he received about 70 additional pages of discovery last night. He said he has an expert looking at the additional discovery.

Darrow is asking for a few hours to have his expert look at the data. We are going to start with some witnesses that aren't related to this new discovery it looks like.

The jury is still not in the courtroom. The defense and prosecution are discussing special instructions that may be read to the jury before they are shown certain evidence today.

   Defense sent the document to their expert to look at this morning. The forensic examiner is expected to testify this morning. We're going to hear from other state witnesses first to allow the expert to look over the document @winknews

   Back on the record for the Jimmy Rodgers trial. His attorney says they got 70 pages of documents last night relating to data recovered from the Garmin GPS. State says the information is not different than what defense already has @winknews

The state is calling its next witness. It's Jason Duvall. He is North Fort Myers Wal Mart employee.

In 2015, Duvall worked for the Wal Mart on Six Mile Cypress Parkway in North Fort Myers and helped investigators recover surveillance video from the store, he said.
