Ethan Hauschultz killing: Judge won't reduce bail for foster father

MANITOWOC – A Manitowoc County judge on Monday refused to reduce the bail for a man who's been jailed for nearly three years in the killing of his foster child, Ethan Hauschultz.

The lawyer for Timothy Hauschultz argued that information has come out in court that paints his client in a better light, and argued that Hauschultz's $100,000 bail should be reduced to $10,000 as long as he is required to wear an electronic-monitoring bracelet. He has been held in the Door County Jail since his arrest in 2019.

"The court has more information today," attorney Donna Kuchler said, "that is supportive of Mr. Hauschultz."

Manitowoc County Circuit Judge Jerilyn Dietz, however, said she had to balance the needs of the defendant with those of the community, as well as to make certain Timothy Hauschultz doesn't flee before his case goes to trial.

Those involved in the case were back in Manitowoc County Court for almost three hours Monday afternoon to hammer out issues before Timothy Hauschultz can go to trial on a series of charges including felony murder. A trial had been scheduled to take place this week, but attorneys were not able to resolve a number of pending issues that would allow a trial to begin.

Any hope the attorneys had of wrapping up the case before the end of the year went out the door when the court ran out of time to address other pending motions, including how audio-visual recordings of statements Ethan's siblings made to sheriff's investigators will be handled.

Lawyers now will argue that motion on March 16. The earliest a trial could begin is mid-May, which will be over four years after Ethan died.

11/15/21 Update: Judge Jerilyn M. Dietz presiding. Defendant Hauschultz appeared by video, in custody with attorney Donna Kuchler also by video. Attorney Jacalyn Labre appeared by video for the State. Court does not find that the State has abused its discretion & therefore has no authority to grant the witness authority. Discussion. Defense has no option but to agree to an adjournment. Hauschultz had been scheduled to stand trial starting Dec. 6. However, the attorneys & court have been discussing how to handle testimony from Damian Hauschultz, with the decision Monday to postpone the Hauschultz’s trial. Because he has appeals pending, Damian Hauschultz would invoke his Fifth Amendment right & not testify, defense attorney Donna Kuchler has said. With Damian Hauschultz deemed legally “unavailable” to testify, Timothy Hauschultz’s trial in connection with the death of Ethan has been postponed indefinitely. 3/15/22: Defendant's Motion to Dismiss. Next motions hearing on 3/16/22. Decision hearing on 5/19/22. 3/16/22 Update: Defense attorney Donna Kuchler asked for the bail to be reduced to $25K or $30K cash, saying it’s uncertain he could even post that much. Manitowoc County District Attorney Jacalyn LaBre argued for keeping the bail as is. Judge Dietz said she was “aghast” at how long the case has taken, noting the first trial date was canceled due to the pandemic, and the second was canceled because of the unavailability of Damian Hauschultz. If Hauschultz posts bond, he would be required to wear an electronic monitoring bracelet. The bail was reduced to $75K cash, since Timothy Hauschultz has been held in jail for more than three years – with no trial date in sight - because he hasn’t been able to post the $100K cash bond. Attorneys plan to call Damian Hauschultz to testify at Tim Hauschultz’s trial. However, until his appeals process is completed, Damian Hauschultz would invoke his Fifth Amendment rights & not testify, his attorneys have said – putting the case against Tim Hauschultz on indefinite hold. Given the appeals court process, it is unlikely a trial for Timothy Hauschultz is held in 2022. Pretrial motions continue in the case. Attorney Kuchler, again pointing to the more than three-year wait so far – with no trial date expected to be set for months – also has filed a motion to dismiss the charges. That issue will be heard, along with others, at status conference hearing tentatively set for 4/28/22. Also Wednesday, Judge Dietz ruled that video-recorded interviews done with three children – then ages 7, 8 & 11 – shortly after Ethan’s death will be allowed at the trial.

Hauschultz (7) (April 20, 2018, Manitowoc; burned & buried in “coffin of snow”) – *Timothy Scott Hauschultz (48/now 51) (great uncle) charged (2/4/19) & arraigned (3/20/19) with first-degree reckless homicide, 3 counts of substantial battery & 3 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-death as a party to a crime, 2 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-felony & a misdemeanor battery. Plead not guilty. $100K cash bond. Reduction in bond denied (12/6/21). Bond reduced (3/16/22) to $75K cash.
Trial was set to begin on 12/6/21 (thru 12/10/21) was continued with no further dates available. There will be 5 alternate jurors.

4/28/22 Update: Court states there are 2 Bellows motions on file that will not be heard today. Motion to Dismiss because of defendant's right to speedy trial has been violate. Counsel argue the motion. Court denies the motion. Next decision hearing on 5/19/22. 5/11/22: Order for commitment. Amended Commitment for Failure to Furnish Bail. Adding condition of "any violations of electronic monitoring must be provided directly to the State".
5/19/22 Update: Daubert motion hearing was cancelled. A written decision will be released on Monday, 5/23/22.
Hauschultzes were court appointed guardians for Ethan & his 2 siblings in 2016.
*Tina McKeever-Hauschultz (35/now 39) (great aunt) – 3/12/21: Plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision.
*Damian L. Hauschultz
(14/now 18) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed appeal on 2/24/22.
