Manitowoc County judge refuses to throw out teenager’s statements to police in 7-year-old’s death

MANITOWOC - A judge will allow statements a teenager made to police about his role in the death of a young boy to be used against him, despite a defense attorney's argument that police used "coercive and deceptive" interview tactics.

Manitowoc County Judge Jerilyn Dietz described a series of four interviews at issue and found that in each case, Hauschultz, who was 14 at the time, wasn't in custody — and, as a result, a Miranda warning wasn't necessary — and he voluntarily gave all of his statements to police.

"The totality of the circumstances as to each of these interviews shows these were not custodial interrogations and that each statement was knowingly and voluntarily made," Dietz said at a hearing Monday as she announced her decision.

In court documents filed in late January, Hauschultz's defense attorney, Russell Jones, argued Hauschultz was, around the time of the incident, interviewed by police without a parent or guardian and never informed of his rights.

Jones claimed Hauschultz was subjected to "emotional manipulation" in his interviews with police and asked Dietz to throw out his statements.

In her decision, Dietz found no evidence that Hauschultz was restricted in any way, nor any evidence of coercion on the part of investigators.

Dietz heard testimony related to the issue at three separate hearings over several months and reviewed written arguments from both sides before she made her decision to allow the statements to be used as evidence. Neither side added to those arguments at the hearing Monday.

A scheduling conference in the case is expected to take place Dec. 17, with trial dates potentially set at that time.

Ethan Hauschultz killing: Judge rules case will stay in Manitowoc Co.

MANITOWOC - If Timothy Hauschultz goes to trial in the killing of a 7-year-old foster child, it will be in Manitowoc County.

A county judge on Friday denied Hauschultz's lawyer's request to move the case to another county, saying media coverage of the killing of Ethan Hauschultz would not prevent attorneys from finding 12 impartial jurors.

"The vast majority of the coverage has been factual," Judge Jerilyn Dietz said Friday in Manitowoc County Circuit Court.

Also Friday, Dietz denied two other motions filed by Hauschultz's lawyer.

Defense attorney Donna Kuchler had argued that four statements Damian Hauschultz made to Manitowoc County detectives soon after the killing should be thrown out because the teen had not been warned that he did not have to speak with police.

Kuchler also said authorities should be barred from using some evidence found at the Newton house, claiming Timothy Hauschultz revoked permission to search the property.

Dietz agreed Damian had not been read his rights, but said that was unnecessary for the first three interviews because he was not a suspect then, and that his mother or his adoptive father had granted permission.
