    The Crown v Gerard Baden-Clay, 25th June - Trial Day 10, Week 3

GBC has offered an explanation (of sorts) to the scratches and that will be considered by the jury. Neither the leaves nor the blood have been effectively challenged, or explained, by the defence and this makes them very important to the prosecution case which is entirely circumstantial...

    The Crown v Gerard Baden-Clay, 25th June - Trial Day 10, Week 3

The leaves and the blood are the two key pieces of evidence IMO that point directly at GBC's guilt. All the defence team need to do is to present an explanation for each, to raise enough doubt in the jurors mind, to water down their significance. Not feeling as confident about this as I was...

Maybe OW passes the collection plate around each Sunday......sort of BC tithe?

That's what makes it an important piece of evidence :)

I wonder how GBC's defence team plan to explain this? If they can't discredit the evidence then their only alternative is for GBC to give evidence under oath that the blood got there some other way. Then he would be open to questioning from the prosecution on a whole range of things. Crucial...

    Allison Baden-Clay - GENERAL DISCUSSION THREAD #43

The successful prosecution of Neill-Fraser, and subsequent appeal dismissals have given the DPP greater confidence to launch prosecutions in cases where the evidence is all circumstantial. Several arrests in cold cases followed just weeks after her appeal dismissal. I suspect there are now a...

Good point I would put the plant evidence into the category of 'compelling circumstantial'. Undoubtedly there would be somewhere else that would have the same mix of plants and I'm sure Messrs Mahoney and Davis have scoured suburbia for another property that would provide the same plant...

I forgot that OW was staying at NBC's....... GBC definitely said in his affadavit for the second bail hearing that he and his parents were watching "The Good Wife" at his house. Of all the documents posted by alioop and makara I find the plant matter report quite damaging to his defence of...

    Allison Baden-Clay - GENERAL DISCUSSION THREAD #43

My brain is now completely frazzled after checking and cross checking all those phone records. A couple of possible irregularities have cropped up and I wonder if anyone else has noticed them too. 1. On the 18th April GBC uses the "Good Wife" alibi to explain the incriminating google searched...

Good point I think I might part with some money and get copies of what's available publicly. At least then I can stop scratching my head and put some of these tweets etc in context!!

    ***Day 3 -Committal Hearing*** 11th,12,13th March 2013

It appears to me that the defence are trying to discredit the financial motive. If GBC bought Ms Frosts business share for $1 then the debt is cleared. Likewise if an agreement was struck with Mr Broom to walk away with no liability then this debt is also cleared. Clearly there is alot more...

Hi All Just catching up after a few weeks away. This house sale issue is looking very unsavoury indeed. Regarding the directorship of WOTS, depending upon how the company was structured, and what the percentage of shares Alisons owned, her estate maybe entitled to a seat on the board...

I prefer Chicago referencing as it lends itself to citing online sources. Also MS Word footnotes fit nicely into Chicago. Really throws me out when a non law lecturer wants Harvard referencing. Totally off topic

The only problem I see with the theory that the Prado being involved is that it was released back to GBC prior to his arrest. IMO if it had any forensic value at all it would still be impounded along with the Captiva. Just MOO.
