I am sometimes charging my watch and leave the house forgetting to put it on.

I was thinking more along the lines of an SOS call to emergency services, waving to other boaters or screaming for help! Though, we don't know whether he tried the last two, it just wasn't mentioned in his statements to friends or in anything I have read in the media.

I think that if you are aware that someone is drowning and you knowingly don't take correction action to assist you would definitely be charged with a crime!

In Canada and the UK people who are arrested have the right to a lawyer. Police must inform you of your right to free legal advice, and they cannot question you until you have received that advice, unless there are exceptional circumstances.

When Anna Kempner was murdered on a Carnival cruise in International waters the FBI took control because she was a US citizen. I would imagine that the same would appy here.

Also, why on earth would she be swimming to shore? If she just 'bounced' off the dinghy wouldn't she be more likely to be swimming TOWARDS it??
