I was thinking more along the lines of an SOS call to emergency services, waving to other boaters or screaming for help! Though, we don't know whether he tried the last two, it just wasn't mentioned in his statements to friends or in anything I have read in the media.
I think that if you are aware that someone is drowning and you knowingly don't take correction action to assist you would definitely be charged with a crime!
Earlier he said that he last saw her swimming towards shore! That struck me as odd. Why would she swim towards shore or the sailboat when the dingy was so close by??

In Canada and the UK people who are arrested have the right to a lawyer. Police must inform you of your right to free legal advice, and they cannot question you until you have received that advice, unless there are exceptional circumstances.
When Anna Kempner was murdered on a Carnival cruise in International waters the FBI took control because she was a US citizen. I would imagine that the same would appy here.
