The evidence the prosecution has for the murder charge and if it's lacking in proving intent, may make a difference in a plea bargain, him being convicted of murder or in his sentencing if convicted.
The reason for this discussion on the murder chg is because it gives different things to consider other than he intentionally killed her. I assume this is because Ky only has 1st degree murder and they did not want to knock this down to manslaughter.
Until the murder charge was announced, Law Enforcement had not labeled any of the three men as persons of interest or suspects as far as telling the public.
That's one of the reasons many felt Savannah had just ran away.

David Sparks was never labeled a suspect or person of interest to the public. It seems Law Enforcement is still investigating and the last info given on the two other men was they are not cleared. I think it's still possible they'll be charged. maybe they're waiting to see what all David has...

I would think if it was strangulation, puncture wounds or bone fractures that would show he intentionally tried to kill her and the murder charge would read like the killer had intent to kill.
I agree that this could fit but like you say, why haven't the other two men been charged? What if David was the one who had the drug and gave it to her without the other two men agreeing? Possibly they've told law enforcement David did do this. I keep thinking about the supposed cell phone...

I think these are good scenarios. I was reading how the law applies in different States with 1st degree, 2nd degree, 3rd degree, manslaughter etc. I'm stumped because of Ky only having 1st degree murder. Next is manslaughter. Without intent it seems it would be manslaughter.
I can think of something but can't discuss it now, it's against the rules at this time.
Think I can add this without being in trouble for breaking any rules. They found blood that was not visible and we don't know how much blood was originally there on the closet door.
When I started considering a plea deal and looking at the laws in Ky, I came up with about the same amount of time as you have for what he'll most likely be sentenced, I thought 20+.
