I agree.
I don't think his lawyers were ever going for an NCR defense. He passed too many tests indicating he was fully aware of his actions and the consequences. In fact I think they are going to go in the direction that he is making all of this up and is seeking fame and attention. Loner...
Why was Derek's own blood on his clothing?
This was part of the plan. But how and why exactly...Im stumped
Hanne house was clean of DNA. Derek was much craftier than he looks.
Maybe some confessions tomorrow will give more insight.
Copied from a church webpage!
I feel like he didn't have a computer and he used someone else's to look up the times, so he wrote it down. But I wonder what the significance is. I thought the church might be close to where he took Hailey but I can't find the map. Still, that is a lot of days to...
I should have been more specific - sorry about that. On DS's notebook page submitted as evidence (it was on the last thread) you can see some of the words Dereck wrote on the back page coming through. I actually read others trying to decipher it on an article and they had the "Mass" part. I...
I've been trying to decipher the words on the back of the list on his note pad. Just out of boredom.
Some words I can see but nothing that makes any sense:
-Adoration
-it's Friday
-Sunday
-Mass
-4:30
-after
Reigious connotations that he has given this name to in reference to something he is...
I just came to catch up and a couple of things occurred to me.
1. The "sleepers for the dogs". I just now thought that maybe he broke in, gave something to the dogs to make them sleep so they wouldn't bark and then killed HM in her sleep. But he left the dogs there, with no one to care for them...
Interestingly enough Hersh Wolch commented on this case in a CBC interview and the topic of innocent people being wrongly convicted. He is a very credible lawyer and is very knowledgeable on this topic. We may have the technology to prove if someone is guilty of a crime if DNA is involved but...
This is a good question. I am not completely sure of the answer, someone else might know more, but generally a Supreme Court ruling that is appealed will face the appeals panel which is 3 judges. I'm guessing though there is no definitive answer here because it could be dependant on the charges...
A verdict by judge alone is just as likely to be appealed if the defence can find any questionable findings indicating that the judge may have been biased. It happens frequently. Jian has had so much media attention that selecting an impartial jury would have been almost impossible in TO. His...
Since a jury trial requires a unanimous vote to convict, it's not a risk at all to be tried by jury in an innocent plea. It only takes one vote and as has been mentioned here a couple times, Jodi Arias is prime example of how that can work to the defendants benefit. There are many more.
Patrick Edgerton works with Peter Northcott who was hired to represent DS. A case such as this usually has team of criminal lawyers. Patrick is probably an associate representing Peter's team at this point.
I'm quite sure you are correct. This isn't the exact reference from the Canada criminal code as I don't really want to search for it, but this is the overall premise you speak of:
"Under the merger doctrine as this term is used in criminal law, lesser included offenses generally merge into the...
This is pretty common though for small towns. Kids get bored and commit petty crimes. It spikes and wanes just like anywhere else. But yes, the pass was obviously having some issues.
I am not trying to make sense of an illogical situation. But I have a suspicion that the emotional well being of...
Cheyenne gave an interview to the Calgary Herald. I really hope she doesn't get ripped apart again. I feel so sad for these families.
