I think here we are rapidly leaving the realm of reasonable doubt and entering the realm of hypothetical doubt in which any scenario, no matter how unlikely can be brought to bare and it becomes impossible to prove a suspect guilty of anything.

It would be really informative to get the details on the assault charge. Ordinarily I would assume they would be public record, although if the person assaulted was under 16 I suppose they could have been sealed. I know the UCMJ has different rules from civilian law.
