This is an excellent point. Read section 1 of the Capital Murder part of the VA Code: https://vacode.org/18.2-31/ It specifically lists intent to defile... unless they aren't confident about that charge sticking, there's no reason he shouldn't be charged with Capital Murder.

That seems like a really random witness that the defense was holding onto in an effort to undermine the prosecution's timeline. But there was no evidence provided of this.. I know that parking garages have surveillance cameras. The woman was probably someone who submitted a tip to police that...
