I'm just relieved that the jury will have to accept the guilty verdict as fact. Hopefully no stealth Temple fans will somehow get on and muck the next one up.

Couldn't agree more. That's how it SHOULD be but imo Temple never should have had his first conviction thrown out, Gist was terrible. I get the sick feeling that somehow Temple's defense has influence on public officials. I hope I'm wrong.

Thank you for this! Whew, at first I thought the entire thing could be a mistrial! So if there is a hold out and that person wants something ridiculous like 5 years or god forbid probation, then a new jury will be brought in just for punishment.
I wonder if Temple would still be out on bail...

I wonder what is taking the jury so long? Also I have the same question as you, what happens in the punishment phase if the jury can't all agree?
