The code is confusing. He's charged with First Degree Murder as well as Second Degree Murder. Most likely he's charged with both so the jury will convict him one way or the other.
First degree murder does include premeditation, poisoning, abduction, lying in wait, rape and many other things...
That's what I was thinking. I guess the previous post was speculation posted as fact which seems a bit counterproductive if not libelous if the poster doesn't have some direct knowledge of the circumstances the rest of us aren't privy to.
Maybe she was forced, maybe they were using together, hopefully the details somehow come out at trial. As for the relationship and age, she was 18 when she died, so I don't think her age will lead to any enhancement in charges or convictions. Which is kind of screwed up when you consider that if...
Yeah, that had been out there for a while. Without other damning evidence, I would imagine his defense will consist of claiming that she ODed on heroin herself and that he merely concealed the body. Concealing a body isn't that much of a crime in Virginia. In this case it looks like a Class 6...
If he wasn't already locked up for the ammunition charge, I would think the delay is a tragedy in and of itself. In this case, I think it was smart for the police to wait until they had a solid case.
