They surely have DNA from his apartment - but without a sample directly from him they can't prove in a court of law that the DNA is his. DNA from his apartment is just considered DNA from somebody who had been in his apartment..... They need DNA directly from him to be certain.
Good point. Yes, in VA DNA samples must be destroyed on acquittal/dismissal:

If samples have been shared with other agencies (e.g. FBI), however, there are not necessarily provisions requiring that those agencies also destroy...
Doesn't appear that he changed his appearance at all either (based on the blurry twitter pic of him in custody.)
So he goes to DMV to get a new license photo **the day before he flees**.
And then does nothing to change his appearance........
