The issue in this thread is supposed to be: what impact does THC in TM have on the case,
certainly:
- it proves he was OK with breaking Florida law
- it proves he was using MJ
- it helps build the case for the prosecution that he was a bad kid / gang wanna be / drug user /...

T's father was surprised with the recording and asked by LE (law enforcement) for an opinion if it was his son... he responded right away that it wasn't....

you wouldn't qualify for SYG as they own the property and are legally entering after notice... so you can't establish a home defense presumption of forcible felony... see you in 40 years.....

it really sucks that T is dead, but it's a valid SYG claim, unless some actual evidence (not assumption, innuendo, gut feeling or other) emerges that G started the ACTUAL altercation. Following someone is not assault and it's not illegal.

- a broken nose does not always result in a large amount of swelling and a crooked nose like from a fight movie... frequently they can be closed fractures of the upper nasal bone with no deformity... I've had one

IMO.... the presence of THC in general is a very minor issue... but in the context of the case it will have significant import:
the entire case is: who initiated the fight?

I think you are right.... 90% plus chance of going to trial and it will 100% hinge on selection .. nobody wants to make that call... but if this was an every day case... 100% chance that there wouldn't have even been an arrest

I would disagree that simply because there was no DNA or prints on the gun that there wasn't a struggle for it.. it is small enough to be substantively covered by Gs hand... could have been significantly 'wiped' by subsequent handling by G and...
