Note, AT didn't even offer star-gazing as his alibi, just barfed it up as explanation for nocturnal commissions -- she might even produce a Polaroid of a star BK once saw -- but I don't think anybody believes he was star-gazing that night or on the nights of his Tour de Moscow loops. Whatcha doin' in Moscow, BK? The sky over Pullman has the same number of stars.

His alibi was weaker than even that. He liked early morning drives because in the past he's been known to stargaze.

(One wonders whether BK has worm out that alibi in the past, if ever he was caught hot prowling after dark? Who me? I'm not prowling. I'm stargazing. Why all the black? Why the mask? Well, that's how we stargaze in PA. I didn't know the rules were different here.)

I do want to point out, to AT, FWIW, 2, 3, 4 am isn't really 'early morning' to me. You know, as he's known for his 'early morning runs'. If say 2, 3, 4 am are the bewitching hours. If you're not up because of an alternate work schedule, fair chance you're going to get a side eye.

Why does BK always seem to be awake when other people are sleeping?

I daresay BK so far has the worst alibi I've ever heard. I was driving in my car, with my phone off.

I guess when defending a patently guilty person the burning trash from a dumpster at least feels warm for a while.
Honestly, what's left?

Chain of custody on the sheath DNA? Sloppy police work and a frame job? None of that works because they didn't know whose DNA it was.

Two Elantras? Shell game? Some are BK's Elantra? The one nosed away from Moscow. And the others aren't?

There's just nothing for her to work with. Just cross examination. She'll have to go hard at witnesses, try to rustle up doubt.

I wonder if they'll put up a defense or just try to push the State's case on cross.

We might as well start talking about aggravating amd mitigating factors, for the sentencing portion of BK's future. Aggravating -- burglary (breaking and entering), multiple victims, particularly depraved and henious....

Mitigating? Guy goes from seatbelt violate to mass murder. Visual snow.

I wonder if BK is receiving any mental health care. He's competent. He's sane. I'm thinking probably not suffering from significant mental illness but likely sporting an array of personality disorders. Maybe all of them.

Makes it all the more chilling really, that someone could do -- stone cold sober -- what he did.

Probably went home and made himself a regimented Vegan breakfast before heading back out, expecting to a house lit up with LE and media.

I wonder if, for a moment, finding everything quiet at 1122 King, if indeed he drove back that way, he wondered about HIS perception-- whether it happened or whether he'd imagined it. His whole life might have felt like that for him.

I can't a scenario, however, where he comes out of this trial in any way a sympathetic character. If anything, he's devoid. Will that rise to the level of mitigation?

Autopsy photos will eclipse that.

Mercy won't be his.

I will go against the grain and say I don't think the issue with the model years is completely conspiracy theory or completely made up on AT's part. Once the defense learned that IGG was involved, I think it's the job of the defense to make sure the suspect fit the facts, not the other way around. If they don't have the date the name was produced, they can't know for sure the model years weren't changed because that's what BK drove. It was pretty late in the game when they finally got that date. I don't think it's a Franks issue but just in general, I think it's a valid question.

Although the court denied a Franks hearing, I assume that AT is still able to bring up these issues during the trial. The issues she raised were adjudicated to remain in evidence, but even though they were not thrown out, I assume she is likely to raise many of these issues during the trial as part of BK's defense.

She also has them on record in the event of any further appeal(s).

The model years were expanded to include models up to 2016 on 11/26.
Before public was informed of the BOLO for an Elantra.

IMO? That final approval for the firing squad.


The mitigation phase of the trial may result in ruling out the death penalty, and it isn't known if this bill will pass in the state legislature and if the governor will sign it into law. So premature to bet on this direction, IMO.

Right--we haven't really known for sure until the judge's orders yesterday that the years were expanded before the IGG produced the name. And the defense allegedly didn't know they were expanded before the IGG produced the name until they had the date the IGG produced the name. I'm glad the model years were extended before they had the name--it wasn't done because they knew what BK drove and it makes it a non-issue in my opinion.

I don't think we know they got that date late in the game. I can't imagine this wasn't immediately disclosed somewhere in discovery. I've followed countless cases where attorneys feign ignorance in order to put a certain narrative out there. In this case they wanted to make it appear that law enforcement reverse engineered this. There was a mountain of discovery, so they had plausible deniablity in regards to what the actual facts were.

The whole point was to play to the cameras, and through that, influence the general public. We know they wanted those hearings broadcast, as it would allow them to throw out a bunch of misrepresentations to make the public question the official narrative.

That's why we heard about DNA magically growing (simply a part of the process, which they would know), about the car changing, etc.

I don't think it was a vacuum either, JMO.

Due to the presence of his parents (and possibly his 2 sisters) and that the FBI knew BK regularly ran in the neighborhood, I think LE should have simply picked him up just after a run when he was tired and just before arriving back to his parents home. No need to terrorize his parents and damage their home. The parents did nothing wrong. JMO.

Dog Crate and KG's purse were both found inside of KG's new car according to Mrs. G. It is perplexing. Was KG getting ready to leave? Not sure. JMO.

Is Idaho different than other states? Or was the area much "safer"? I don't know anyone who leaves their purse in their car while they are sleeping inside. Not ever.

College kids don't think like us, to most of them, the world is a happy, friendly place. And I know that living in Montana, Idaho, we feel insulated from violence.

Which isn't the case. Unfortunately. I have never felt safe since a teacher in Sydney, MT was kidnapped and killed while out running.

And I have no doubt that people in Moscow, ID have really upped their security since these murders.

If the defense has nothing else, I expect them to hammer on the food delivery guy, the roommates in the house, and KG's boyfriend.

That was the disgusting defense that Molly Tibbets killer went with, to blame her boyfriend. It was horrible to even listen to the far fetched tale spun by the killer. I don't even know how his attorney could put him on the stand, allowing his client to lie on the stand. Subjourning perjury?! Isn't that what it is called?

Will BK try to take the stand and offer some sort of story?!

I think they said at one of the hearings they had just found out during the closed testimony what date the FBI gave the name to Moscow law enforcement--but I agree that's probably not the case. Blum reported in his book that the FBI had the name as early as 11 December and gave the name to Moscow 19 December. I'm sure they read the book lol. They had two competing arguments going on--that nothing was known before the IGG/name and that the IGG/name was known before the model of the car was changed. When the dates were revealed, one of those arguments was going to go down in flames.

The reason I think it was subterfuge is AT handwaved those emails in her franks motion knowing full well they said the opposite of what she alleged. Then the Judge pulled her up on it.

Not sure, but I still think we're in the dark regarding if it was actually Murphy barking? Hippler doesn't go into detail about the results of the inside/outside tests. Jmo guessing there were other dogs present in the immediate neighbourhood. Moo
Catching up and typing this as I am on #12 out of 14...

Early on, like back in #20 - 30 there was talk of Murphy. Someone posted a link to an interview Kaylee's sister gave where she stated Murphy was very timid and was probably under the bed or curled up in a closet. Something like that...I'm still searching for the post or article so MOO.

I seem to remember that it was a neighbor dog that started barking after a "thump". We all talked about someone hitting a wall or a trunk to a car closing.

Anyway, that's my recollections on those things. JMO.

Reading through these judgements is like a breath of fresh air. The judge sure did clean house.

Obviously, hence the "final approval" in my post as well as the article stating it’s in process. I never mentioned it being a done deal or remotely inferred it was worth a bet. It was an answer to a question of "what’s left" & nothing more. One thing is for sure - that legislation didn’t just come out of thin air on a whim. Regardless, we’ll see one way or another.

I wish AT & whoever else luck in convincing the judge or jury (whichever gets to decide) that a person who stabbed 4 people so many times that blood was shown leaking through the walls to the outside of the house in press photos doesn’t deserve capital punishment, especially if it’s shown that this was planned out over the course of months. CS photos tend to stick in the minds of jurors, should they carry that decision.

Either way, there’s a long way to go & Bryan likely will remain in prison for the rest of his life, however long or short that may be & from the looks of things so far, he’s earned it.
