This evil creature is why I always lock my bedroom door at night since my husband died. Not that I am armed or anything, but I won’t be ambushed while I sleep.
Same, but armed and with ADT security. I can't stand the thought of someone sneaking up on me, it's a serious issue. What happened here is literally my worst nightmare come to life.

Bless the victims, I hope they were asleep (Xana was awake though) and didn't have time to fully register the shock and fear. The surviving roommates too, they have been forever changed. :(

Looks like we have a bunch of new documents coming, hopefully tomorrow.

I’ve never followed a trial where the defense says, yeah, okay, put our guy on trial, but you can’t use witness statements, direct evidence, circumstantial evidence, documentary evidence, any other kind of evidence, and especially, you cannot use a physical description given by a witness.

I understand an attorney mounting a vigorous defense, but is every single piece of evidence up for debate BEFORE the trial even begins?

This really isn't all that unusual. Both sides try to limit the other side as much as possible, and it's up to the judge to decide if these arguments are valid or not. The evidence is overwhelming here, so the only way the defense can win is by keeping out as much as they possibly can. It's a death penalty case too, so it's in their interest to contest absolutely everything, to preserve this stuff on appeal.

I'm looking forward to the defense response to the Amazon Click Activity, which should be published today. I'm hoping for unequivocal confirmation that the Kbar Kohberger purchased does in fact match what was found at the scene. It was implied in the prosecution motion, but it would be nice to know for a fact.

I'm not sure every piece of evidence has been or will be debated. But better there be debate now if it's ever going to happen. Both sides are creating debate, after all. NOT just the defense.

Three main reasons for it to happen now IMO.
1) Can't unring a bell & telling a jury to disregard what they just saw or heard, is quite unlikely to work. That's just not how human cognition works regardless of instructions given by a judge or any promises made during the much-discussed voir dire process. So planning to debate the admissibility of evidence during the trial when it could be done pre-trial seems problematic.

2) There is a pretty tight timeframe for the guilt phase of the actual trial to occur. Adding foreseeable evidentiary challenges to an already tight timeline doesn't make any sense IMO if there are alternatives.

3) This is a death penalty quadruple murder trial, not a simple assault case. It seems to me some people (not everyone!) expect the case to be defended as if it were a simple assault case, that is, if it has to be defended at all.

Gray Hughes first suggest it was right behind the house. Later, by using the doc dump he changes it to being parked on the side then BK slips into the back sliding glass door.

Great job by GH leading viewers through the car movements.

Stellar job by LE in gathering all that video surveillance, viewing the Elantra movements as well as the views of headlights shining on/passing over particular houses in the area, and putting all the pieces together. That must have been tedious work but those movements really tell the story of the predator circling, circling, and eventually closing in on his victims.

That first time he closely circled between 500 Queen Rd and 1122 King Rd and appeared to have stopped for nearly a minute, I wonder if he used that minute to stop, open his trunk, grab a duffle (or some type of) bag and drop it in the side/backyard of 1122 King Rd and then later - after the murders - used that duffle to store his mask, coveralls, and shoes after quickly peeling them off after leaving the residence. Then, grabbed the duffle to place into his trunk before leaving the scene. Maybe he had even placed something - a couple of traffic cones or small sawhorses - to temporarily "save" a parking place for himself on the sloped driveway between 500 Queen Rd and 1122 King Rd while he continued to circle to assure himself lights were off throughout the house.

I am, I suppose a normal guy, but with knowledge & study of sinister people from my work life.

That being said, even though I felt pretty secure, I installed 8 cameras and a stand alone alarm system in my house to protect my family.

It has been used 2 or 3 times over the past 10 years. Nothing big jsut a car theft in neighborhood helped identify criminal responsible, teenagers opening doors on cars and a delivered grocery theft at next door neighbors porch.

But the real reason for installing both was my wife was up (not dressed) getting a drink of milk in the kitchen at 4AM, and she sees a man walking by the window... in a place that nobody could confuse as a short cut.

That did it for me. I got a camera system within a week and although it took me 3 weekends to install it, I am so glad that I did.

He has had a lot of nails in his coffin at this point. I wonder if they have records of him buying excess cleaning products

For someone that has a masters in criminal justice he did some really dumb stuff. Just from watching dateline and 20/20 you learn that anything paid with credit card can be traced.

There doesn’t seem to be anything pointing to that in that particular filing. A lot of things they intended to use, they are no longer using (Walmart stuff, winco, etc).

Walmart always gets them!

The timing of this isn't particularly damning, but if you couple that with other incriminating purchases around the same time, it could be very big.

Regarding purchase history, the State is attaching a “Certificate of Authenticity” dated 12/30/22 pursuant to I.RE. 803(6) and 902(11) from Amazon.com. State’s Exhibit S-1. This Certificate was included with an excel data file that details Bryan Kohberger’s subscription information and order history from January 5, 2022, to December 13, 2022.

Defendant's Reply to State's Response, MIL, RE Vague and Undisclosed Expert Testimony

Whoa.

State's expert has BK in Moscow (utilizing a certain tower) between July 9, 2022 and November 7th, between 10 pm and 4am -- 23 separate times

Good, cuz he's gonna need that coffin completed, and soon.

Agree, the evidence is already overwhelming.

Most juries are pretty much common sense people.

DNA match
Description by witness does not exclude him
Phone data (off only when near crime scene then back on south of town)
K Bar knife purchase
Mask purchase
Acting suspicious in PA
etc, etc etc.

This is pretty straightforward and is why AT is spent all of her time on trying to throw out evidence.

Defendant's Reply, MIL, Use of the Term Murder

AT is still jammering -- doesn't want the State to use 'murder' in any form in reference to BK because he's "presumed innocent".

Never mind that he's on trial for murder.

He has an inability to assist with mitigation evidence and understand the magnitude of his case. By way of example, when he was arrested in his home, with a full swat team, doors broken, and parents zip tied, he made small talk with the detective in the back of the car during the ride to the police station. He asked the officer about his education and suggested that they get coffee at a later date. He did not perceive the profoundly serious nature of the moment and exhibited no perception of what was happening.

I hope that any lingering cognitive dissonance (not an expert, not an official diagnosis, MOO) of Kohberger the Criminology PhD student and Kohlberger the Bumbling Quadruple Murderer dissipates for the people still speaking in favor of his apparent brilliance being evidence of his innocence.

We've all seen the Dateline episode with the black and white overhead shot of a Home Depot cashier and/or self checkout with the #1 suspect buying supplies to cover up their crimes. We sit there and shake our heads at the idiocy (IMO) of it all.

Kohlberger's gone a step further and is giving us literal receipts to his preparation and carrying out of the crime itself.
