Well, I guess we can see where the defense is going to go if all their filings are ruled against:

"By way of example, when he was arrested in his home, with a full swat team, doors broken, and parents zip tied, he made small talk with the detective in the back of the car during the ride to the police station. He asked the officer about his education and suggested that they get coffee at a later date. He did not perceive the profoundly serious nature of the moment and exhibited no perception of what was happening. While competency has not been raised in this case, at this time, Mr. Kohberger’s team and assisting experts are constantly analyzing this issue. "
I thought that Idaho didn’t have NG By reason of Insanity. Is this where she’s going?

Also, he wanted to be a cop not going to miss the chance to hang, criminals do this all the time.

State's expert has BK in Moscow (utilizing a certain tower) between July 9, 2022 and November 7th, between 10 pm and 4am -- 23 separate times

Well, apparently the shopping really is better in Moscow, especially between 10pm and 4am., and especially when you are shopping for college girls to murder.

No but he has not yet been convicted of killing 4 people either. Thinking he's guilty is fine but at this point, it is not a fact BK killed 4 people.

While most people with Asperger's don't kill people, there's nothing in the diagnosis that would necessarily prevent all violent behavior. Plus, at least at this point, AT is not arguing the diagnosis means he's not guilty of the crime.

The post I was responding to seemed to say he couldn't have Asperger's and have been accepted into a doctoral program. That's just not true. And the spectrum behaviors listed that supposedly would have prevented admission to a doctoral program like his-- difficulty teaching and interacting with colleagues-- are things that DID give him trouble. So his doctoral performance argues FOR the diagnosis IMO, definitely not against it.

Well, apparently the shopping really is better in Moscow, especially between 10pm and 4am., and especially when you are shopping for college coeds to murder.
To be fair the only 24 Grocery in the area of Pullman Moscow is Win Co in Moscow.

Defense has no intention of not hammering this in hard during cross examination, IMHO.

As someone who didn't drink in high school and doesn't really drink as an adult, I'm always surprised at young college students' ability to handle large amounts of alcohol. Being 5'10" probably helped DM, but dang. I'm impressed she could text fairly coherently at 4 in the morning.

And they definitely don't want the BK selfie to come in:
The Court must additionally prohibit the State from acting as an identifying witness by admitting a picture of Mr. Kohberger in evidence in support of D.M.’s testimony or for any other reason.

AT doesn't know her client. "Inability to assist with... and understand the magnitude of..." is not the same as "unwillingness to assist with... and acknowledge the magnitude of."

And "did not perceive the profoundly serious nature ... and exhibited no perception of..." is not the same as "believed he had the capacity to baloney his way around the profoundly serious nature...and exhibited the strength of that belief in his behavior with the Defense team."

One gets the sense that BK had lots of early training in BS'ing to avoid consequences for his behaviors before those around him began questioning his trustworthiness and willingness to accept responsibility. It's like that traffic stop in Moscow. The officer repeatedly told him what law he broke but he just kept trying to talk his way out of the ticket. Twice, he claimed victimhood to absolve himself of responsibility in just that one encounter with the law: first, he claimed a car ahead of him acted differently than the driver had signaled, and second, he claimed that he was from Pennsylvania where they don't have crosswalks like that particular intersection did.
Sorry, being from another state doesn't get you off the hook legally. There's a saying I can't remember right now because I'm coming off a Migraine this morning about not knowing the law isn't a legal defense...

They don't.

Competency in this case would be relevant to whether or not he can actually be considered to be fit to stand trial: i.e. is he able to understand the proceedings against him and assist in his own defense. If he is not, then typically the individual undergoes psychiatric treatment to attempt to restore them to a state of competency before they can be brought back to court and have a trial proceed.

But yet....they've had all this time to work on ascertaining this fact, to question it, to get it evaluated.

But only now, once it looks like every strategy they have is being ruled against, do they begin to float this as a potential issue. Despite claiming his behavior at arrest was abnormal.

Look, State of Idaho found "Lori Vallow Daybell" Competent for trial. And she comes off as completely bat $&it crazy to me.

No way this killer is gonna be deemed incompetent to stand trial. She is certainly pulling out all the stops, as she should, and although I think AT has already conceded, in her mind, that the guilt or innocence phase of his upcoming trial is a lost cause, she is going to work like hell to keep him from getting the DP. JMO

my favorite part of this whole thing is when his lawyer says he can't get a speedy execution and having to wait for them to construct the shooting gallery etc..could take unspecified and unusual amounts of time ..cruel and unusual...and Judge just shot back, oh no..shouldn't take long, as I understand it they are. building it as we speak....LOLZ...mOO

But the things you list that might accompany Asperger's are things that did give him trouble in his doctoral program. For example, interacting with colleages, performing TA duties, and so on.

I don't think what we know about his grad school performance rules out the diagnosis. And the effect of COVID made lots of grad programs weird during the time he was doing master's work.

It’s not about what I listed, it’s about what BK’s own attorneys say in that motion. Their descriptions of his affect and behavior have him sounding very severely impaired, way beyond just giving him difficulties in college.
