I join you in this. It must have filled family members with hope that just a few years after rehab for addiction to a serious drug, BK seemed to have straightened himself up physically and found a vocational path in which he excelled (at least while studying at DeSales). His father clearly looked proud when pointing out that BK was in the doctoral program at WSU when they were stopped for a traffic violation in Indiana.

The arrest weeks later for such a heinous crime must have been devastating and the prospect of the death penalty compounds that devastation. Yet, it cannot be denied that all those consequences and their likely impact upon his family members was known in advance by BK.

It’s not about what I listed, it’s about what BK’s own attorneys say in that motion. Their descriptions of his affect and behavior have him sounding very severely impaired, way beyond just giving him difficulties in college.
That may be true. But we don't know the kinds of "daily life difficulties" BK faced. We know when they arrived in Washington, his dad was trying to find people to be BK's friend. And we do know BK had trouble relating to graduate school colleagues, both faculty & students. Are people really arguing BK did not show signs of social impairment?

No but he has not yet been convicted of killing 4 people either. Thinking he's guilty is fine but at this point, it is not a fact BK killed 4 people.

While most people with Asperger's don't kill people, there's nothing in the diagnosis that would necessarily prevent all violent behavior. Plus, at least at this point, AT is not arguing the diagnosis means he's not guilty of the crime.

The post I was responding to seemed to say he couldn't have Asperger's and have been accepted into a doctoral program. That's just not true. And the spectrum behaviors listed that supposedly would have prevented admission to a doctoral program like his-- difficulty teaching and interacting with colleagues-- are things that DID give him trouble. So his doctoral performance argues FOR the diagnosis IMO, definitely not against it.

State's expert has BK in Moscow (utilizing a certain tower) between July 9, 2022 and November 7th, between 10 pm and 4am -- 23 separate times

My opinion was that his attorney was exaggerating his individual symptoms.
His attorney, in my opinion, would be more effective in removing the death penalty by negotiating a plea deal.
Personally I doubt the state is willing to offer that sort of plea deal. But we'll see.

Now, that would be interesting. Because I don't see the families of the victims agreeing with this. Not that they would have any actual input if there was a plea deal.

But I am pretty sure that some members of the victims families, would be more than happy to do a full tour with any news show who wanted to meet with "him".

Oh, the pain of a catch 22. Using BK's diagnoses/conditions as mitigating factors opens the discussion to the State, to use the same findings as aggravating factors.

So she wanna use them but she wants the State notta. Double standard.

I'm pretty sure if the Defense brings in BK's MH diagnosis it will definitely open the door for the State to have access to those records and an opportunity for their own testing or a rebuttal witness.

Defense has no intention of not hammering this in hard during cross examination, IMHO.

As someone who didn't drink in high school and doesn't really drink as an adult, I'm always surprised at young college students' ability to handle large amounts of alcohol. Being 5'10" probably helped DM, but dang. I'm impressed she could text fairly coherently at 4 in the morning.

And they definitely don't want the BK selfie to come in:
The Court must additionally prohibit the State from acting as an identifying witness by admitting a picture of Mr. Kohberger in evidence in support of D.M.’s testimony or for any other reason.
The white claws are low alcohol content, plus they don't know how much of the 'Borg' DM actually consumed. The Defense also failed to quantify the amount of food and water DM had consumed during that period of approx 16 hours also.

I'm not suggesting DM wasn't buzzed, but I do not believe she was falling down drunk or passed out because she would have never heard the noises if she were.

No way this killer is gonna be deemed incompetent to stand trial. She is certainly pulling out all the stops, as she should, and although I think AT has already conceded, in her mind, that the guilt or innocence phase of his upcoming trial is a lost cause, she is going to work like hell to keep him from getting the DP. JMO
Agreed, and that is the right and constitutional thing to do, even if I believe him to be guilty.

BK doesn't care about his family in the traditional sense of the word. I feel for his family, his father in particular. He really seemed dedicated to helping BK out any way he could.

Wow. Talk about protesting too much.

AT says that allowing DM to testify to seeing "bushy eyebrows" is that she as DM saying BK is the person she saw.

Not that's not true!!! It's not the same. It's a detail she recalled. She hasn't even one, to my knowledge, identified BK as the man she saw!

Then AT goes hard at DM (footnote includes DM's liquid diet from the night before (no judgment but it's a wonder she didn't pass out). AT speaks at length about how DM's memory can't be trusted for all the alcohol.

So let me try to summarize her argument:

DM should not be allowed to say "bushy eyebrows", the State can't use photos of BK because it'll effectively ID BK -- and witness unreliability is a great contributor to false convictions....so even BK's own photo is an unreliable witness? Yeah, I say we let the jury be the judge of that.

I am going to go out on a limb and guess that although LE did find some black mask(s) when searching BK's homes in Washington and Pa, they were more likely the Covid type masks that so many of us wore, and not a black balaclava, as it would surely have been listed as such. Hmmmm, I wonder if BK misplaced it at the same time he apparently misplaced his KaBar knife and sheath. JMO

Hey, it could happen. There were probably white Elantras parked in practically every driveway between camera shots. And likely with owners that were up and about to begin driving the neighborhood around 3:30 am. Absolutely no reason to believe it was BK in his white Elantra in any of the shots, but especially not in all of them, and it is mere coincidence that all of the shots, taken together, of the multiple Elantras, form almost a perfect circular route to 1122 KIng Rd, that was repeated multiple times. JMO

And timing of the shots from one camera to the next.

You know, all Elantra drivers are part of a hive mind who operate like synchronized swimmers. It's a pledge all Hyundai owners take. So that would explain all the coordinated mapping of all the different Elantras working in tandem.

Sorry, being from another state doesn't get you off the hook legally. There's a saying I can't remember right now because I'm coming off a Migraine this morning about not knowing the law isn't a legal defense...

To be fair the only 24 Grocery in the area of Pullman Moscow is Win Co in Moscow.
they have his credit card records so they should know if he is buying tofu in WA... of course a person could stalk victims and buy groceries on a weekly schedule...
