I *really* love Judge H's soft and calm voice and demeanor :)

Clearly, Judge Hippler is as impressed with Sy and his expertise and claims as we all are.

  • #123
Now AT is trying to limit what the State's experts can say during trial. Again about missing discovery..

What did I predict? Hippler is ripping AT and Sy Ray new ones over non existent timing advance records. Yep, Inflammatory, serious allegations by AT and her 'expert' with zero evidence. I've always thought this is the first really, really bad mis-step by AT. Moo, she deserves all the reprimanding he can dish out. Hippler appears quite angry and that is how I felt when I first read Sy Ray's offensive, BS affidavit. Keep ripping Hippler. Jmo.

AT&T Timing Advance Records Defense and Sy Ray gets absolutely DESTROYED by Judge Hipler.

Asks defense what evidence they have to support that the prosecution had these records. Hipler talks about Sy Ray ignoring the 7 day retention policy, and how this is a glaring omission considering the inflammatory accusations made in that affidavit."You've made some serious accusations against the state of hiding evidence, yet you've provided no factual basis, zero, that this evidence existed.""Where is the evidence that Mr. Kohberger's timing advance records available from AT&T were available in December?"

"His affidavit is quite extensive, and he seems to ignore that issue (7 day retention period)."A visibly angry Judge Hipler talks about how serious these accusations are, and how he had previously warned the parties of "theatrics." Says this is the sort of thing that could get people disbarred, and Sy Ray ignored the reasonable answer from the prosecution (7 day retention period). Just devastating stuff.

I'm getting the impression that Hippler runs a very tight ship and expects both sides to do the same and to treat the institution of court and what it stands for with respect.

Bodes well for trial.

MOO

Judge H.

Oh but AT is "saving it (alibi) for later" because she hasn't gone trough all of the terabytes of discovery, as IF she expects to find one!
I wanted to smart off and say: "Oh, why don't you just ask him AT?" 😆

I think Hippler is basically telling both the state and the defense that this three-month trial is not going to become a 4-month trial, so they had better start getting their shizz together now. JMO

Hahah AT doesn't seem to want ANY of the prosecution's witness opinions allowed at trial.

I missed that somewhere too then! o_O
I just erased my comment because I wasn't sure if those 2 words weren't diagnosed or he wasn't diagnosed. 🥴

Interesting tidbit from the judge. I don’t think he was talking hypothetically when he mentioned Kohberger purchasing the knife using an Amazon gift card, he had purchased with a credit card.

I missed some of today. Is it true the Judge Hippler called Sy Ray a conspiracy theorist?!

I just watched a bit more of Hippler's response to timing advance issue. Ultimately AT is responsible for allowing SY Ray's affidavit to be filed Hippler went back to his early days on the case. He reminded AT that he expects professionalism from attorneys in his court. The kind of accusations in Ray's affidavit are so serious they could even lead to disbarment. It's clear he is deeply incredulous that AT allowed Ray's affidavit to be submitted. Moo

AJ got up and stated for the record she never received BK TARs. Hippler rules for the prosecution from the bench. He will allow vour dire of Agent Balance if the defense wants that at trial.

I don't think stupid, reckless Sy Ray is going to be very popular with Hippler if he remains in the employ of the defense and testifies. Maybe AT should think about shopping for a new expert, or have a chat with him about putting unsubstantiated, false, potentially career ruining accusations against PAs in sworn affidavits. But really imo AT should probably take a good, hard look at her own lapse of judgement. Moo

He did. He was angry, very angry about Ray,'s reckless unsubstantiated, serious allegations.

Wow. The defense is implying they have no idea how to defend anyone. They need all evidence with a spoon fed explanation of why it is evidence.

No wonder they want to "suppress" that Amazon data information! imo

  • #139
Wow BK purchased the knife, sheath and sharpening equipment (under his name). Then looked at knives again. Defense wants that excluded. (says it's household account)

Regarding arguing about the Amazon info... Judge says BK can produce the knife and say "here's the knife I have it!" LOL
