She just threatened the judge that her alternative is to wait until the start of trial to say she's not ready.

I'm sure that went over well. Dear heavens, I can not even imagine the level of gonads it takes to say that to this judge after how this day has gone so far.

What was his reply?

Is the hearing continued to tomorrow or is it completely over?

The incessant rambling that AT did today + her cohorts was unbearable and dumb. I get that she has to cover all basis due to the death penalty on the table, but she appears less competent than a slug with no legal education at all. moo

I missed the alibi motion. Do you know offhand if any ruling was made on alibi and defense's ongoing lack of compliance with ICRs? Did Hippler rule from the bench?
Here are my bare-bone notes from the alibi segment:

ALIBIS
P==In spite of Judge Judge giving them repeated opportunities, the defendant has yet to establish alibi data only said ‘ I was out driving around’
They have not given a response —no alibi notices
Ray cannot account for the time of crime—we know that


Judge—what about cell phone data of their expert?

P===that will be a battle of cell phone experts

D= BK has consistently maintained his innocence...

Judge—He can testify to that

D- I’ll get to that later—

I disagree that Judge Judge gave us repeated opportunities—Mr Thompson keeps repeating that—our view, that is getting dangerously close to him commented on defendant's right to stay silent...

Judge—I think the issue is about your responsibility to produce an alibi...If you are going to use one


D—Their repeated questions are concerning—I have not been thru every page of very large discovery so I don’t know about any potential alibi yet...


Judge—Mr Ray will say Mr Kohberger was at a certain place at a certain time—if something else comes up then we will deal with that at that time...

Sorry, tried to find it o the prior thread but can't. Someone posted the helpful list of dates for BK until August. Does anyone have it to hand?

Defense hasn't had time to look at discovery. Oh, did I mention it is 68 terabytes?
Right, and AT whined that there was hundreds of hours of street traffic to look through, and it wasn't all labeled w/specifics, so she has to try and look at each one to see when and where...

So is she saying the state should have looked at each one and put a label w/date and location? yah, right....

If she is so certain there is an identical Elantra in the area at the time, I'd think she'd have interns or family members scouring that footage.

My Dad was a defense attorney. When I was in high school, my older bro and I used to go to his office with him on weekends sometimes and look through boxes of evidence, paperwork, receipts etc that he got in discovery. And we had to help him organise it. And put it in correct piles. All hands on deck.

That's what the defense is calling the Demonstrative Exhibit, which the FBI is creating, of the King House.

Apparently it is like a large doll house, and each floor comes off so one can look at each floor at a time?

Just got home from dinner out so I’m super behind, but in context I assume these comments are directed at the defense?????

I missed most of the hearing——on my way now to catch up and I’ll see that this was likely a stupid question to ask 🤪

I got the impression that just the Defense is calling it that, like taking a jab at it.
If AT continues to refer to it as the doll house, maybe the state should put a bloody Barbie inside, and snap her back to the reality that there is nothing cutesy about referring to a model of the house where 4 murders occurred as such. I would suggest that if she ever refers to it as the doll house in trial, that will not be well-received by anyone other than perhaps her client. JMO

Yeah, and ita, what a stupid and needless JAB at the very house where 4 innocent young adult souls perished needlessly and brutally. AT seems to have no compassion or empathy even before trial. Makes me sick how nonchalant AT and crew are about this all. While its brightly evident that the poor 'mentally and physically disabled BK' purchased a knife, sheath, and sharpening tools (pre planned!). How is THAT deficient in any mental capacity?

So funny you would say that. My Great Grandfather was an attorney. And even I remember, as a child, labeling stacks of papers. Everything had to be meticulously documented and cross labeled. Stacks of boxes, papers, files, pictures. When he had a trial, the whole family had a trial. LOL.

It was so that when he is found guilty, they can say he didn't have fair representation because the defense team doesn't have enough ability to mount an actual defense without someone doing their work for them.

Totally MOO, because what did I just watch?

Okay, I’ve skimmed through the last ten pages or so.

Having missed the majority of the hearing, what I garner from the posts here is leaving me gobsmacked.

It seems from what I’ve skimmed that AT and Co. are attempting to infantilize Bryan? Apparently there were comments that he had trouble tying his shoes and forming the numeral 5 correctly?

Did they claim this was when he was a child, or a persistent problem as an adult???

In any event it seems that Judge Hippler is smacking down all this nonsense, seeing as how BK managed to live alone, drive, go to college and so on.

I’m astonished/not astonished that his defense is flailing around, as they really have nothing to support BK as innocent. But I am truly surprised as to how they are coming across as such amateurs.

JMO and thanks to all my fellow posters for keeping the rest of us so well-informed.
