Exactly! But a jury will not have trouble buying into the reason for that switch, from debit card to cash, when presented with the date and evidence to substantiate it. Just one more thing that, in and of itself, means little, but in the bigger context of the timing of events, seems a bit more suspect. JMO

I challenge anyone who thinks it could not be done in 7 minutes... to set a timer and walk around your house or apartment for 7 minutes.

This amount of time is incredibly long for moving up and down in one house and killing people.

I shoot video and 7 minutes is an eternity. It's all about context.

Almost as if he had been training for his Murder Olympics. Strava and similar smartphone apps can get you in a lot of trouble. JMO

Lots of tidbits in here, only have time to post a few:

Heather and Jared Barnhart: experts with Cellebrite who analyzed BK's cell and PC.

"they will testify to their findings pertaining to Defendant's activities on his PC and cell phone for a period oftime before and after the homicides and why gaps in data over that time period are "abnormal." The Barnharts' opinions regarding these topics are fully set forth in their joint report. For example, they observed gaps in Defendant's school PC that "may be consistent with cleaning up" or using anti-forensic methods to clear evidence." Rpt., p. 1. Among the gaps found were in the PC's event logs and System Resource Usage Monitoring between November 11, 2022 and November 16, 2022, which Barnharts opined was abnormal given that school was in session. /d. Likewise, they located gaps in the PC's Chrome history during dates where downloads occurred on the system, indicating the user was private browsing or clearing browsing history."

Michael Douglass:
"For example, the disclosure notes Defendant only conducted ATM withdrawals on and after the date of the homicide and ceased using his debit card after November 10, 2022 whereas, prior to November 10, he had regularly used his debit card."

Detective Gilbertson:
"A report of the timed runs is attached to his disclosure. It was performed to determine if one person could carry out the homicides. His opinion will be that, depending on the suspect's pace and route, he could have carried out the crimes in approximately two to four minutes."

on digital forensics:
"Other than the disclosed opinions by Detectives Mowery and Uhrig that no digital connection was found between Defendant and the residents of 1122 King Road, Defendant argues no specific testimony regarding what the devices and data depicted should be allowed."

I want to reread the part on Ballance and the CAST stuff after I make dinner.

"Based on the foregoing, Defendant's Motion in Limine re: Vague and Undisclosed Expert Testimony is DENIED."

Give the death penalty, get the death penalty.

If, of course, the jury finds him guilty of four murders. Which I hope and believe the jury will.

And if like most death penalty cases, he will live for years, possibly longer than the people he killed, were alive.

I assume that refers to the stabbings themselves. I had it pegged between 3-4 myself.
This is a morbid thought, and I apologize to anyone who may be bothered, because frankly I am as well, but it is one I have considered when trying to get the timing down. Do you think he just stabbed and immediately moved on, knowing the wounds to each were mortal, or do you think he took at least a moment to make sure each of the two upstairs were gone before he moved down to where XK and EC were. I almost feel like he would have wanted to take at least a moment to admire his work. I do think he probably was not able to take any extra time downstairs. JMO

Just gotta hope he took his phone with him everywhere he went.
…..or hope he went to Wal-Mart, the bane of many murderers attempting a cleanup.

Those are very big wins for the state, and huge blows to the defense.. AT better start finding those alternative suspects PDQ. JMO
An alibi wouldn’t hurt either IMO.

I wonder about lighting.

Were any lights on, even briefly? By design even? Element of ambush, hit the switch -- it's one thing if you're ready for it, quick assessment of the room, daze the opponent who isn't expecting it? It's hard to imagine him entering a room blind, attacking by feel. Maybe the ghoul has developed his own brand of night vision/acclimating?

Just how dark were those bedrooms otherwise? The whole crime is reckless but his second and third and fourth victims, I think he wasn't prepared for them and his attacks were less precise than the first. Frenzied. Still, even with the unexpected, he had all the advantages. One-sided fight. He came prepared to kill.

Yes, the DailyMail can be very gossipy at times. They also have been known to dig up quite a bit of accurate news.

At this point we don't know if all that's in the article is true...time will tell.
IMO - I only go to DM for the photos, they somehow always get there first.

The judge added a footnote about the ATM withdrawals, saying:

Without more, the Court has concerns about the relevance of this testimony, but Defendant has not challenged it on this basis as yet.

Before seeing the footnote, I thought about how interesting that information is. My young adult kids hardly ever get cash from the ATM and carry very little. They pay for everything with their debit cards and cash apps. I guess the prosecution will need to lay it out, but the obvious inference is that he wanted to pay cash for items and not leave a paper trail. Maybe he bought supplies that Sunday evening when he went off radar to avoid the typical Walmart/Target cleaning supplies video.
