I agree we knew about 12 times. 23 is new as you say.
MOO I had heard 23 times prior to Dateline.
Pictures of U of ID women is the only new info i think I heard.

Dateline briefly flashed the Amazon click history - records that came from Amazon itself via subpoena.

Then we have his search terms, selfies, and saved instagram images. I've got to believe this stuff came from someone with access to discovery. I think the best possible scenario is that the leaker is a court clerk or something, and not someone affiliated with the prosecution (some former investigator or something).

Oh no—A court clerk! Don’t worry, @DisplacedDivaofthe6C, it’s just a possibility.

Even if the leaker is a court clerk who handles discovery from both sides (vs. a County Clerk of Court who can influence a jury, like in the Murdaugh trial), I don’t think this would derail the case (although it would certainly derail Hippler’s composure IMO).

I'm not too proud of this but last week I got stopped by an Indiana state trooper for following too closely.
Of course he asked me where I was going (as they always do) and I thought "Thai food", lol, but then I snapped out of it and said "home."
He did run my info and gave me a warning then I was on my merry way.
I was not on the interstate and did not get stopped a second time like BK did!

Going back 3 generations is required by law should there be a mitigation phase. In a DP case, the defense has no choice but to do this regardless of innocence or guilt.
Can you provide a link to the law?

This document explains the defense teams requirements in regards to defending BK.

This is Hippler’s first DP case and, far from the slam dunk many try to claim, it is highly complex and now this leaker has added a whole new dimension of complexity to the situation.
That document is what the defense wants the judge to believe has to happen, using whatever case law and interpreting regulations to fit the narrative (imo based on 4 years working as a paralegal in a law office-not criminal law, but I've seen the interpretation tap dance). It is not a written list of requirements that is found in any regulations. That part isn't moo, it's a fact if you read it.

All it is, also totally imo, is a spaghetti list to see what sticks to the wall. Judge Hippler must be exhausted, but fair enough for her to request it. She could ask for an extension due to her client needing to prove he has visual snow(if he has it) and he was unable to see what he was stabbing, but that is not a requirement, nor does the judge have to grant it as being material to anything.

This Guidelines for the Appointment and Performance of Defense Counsel in Death Penalty Cases was an interesting read. 10.11.L states

"Counsel at every stage of the case should take advantage of all appropriate opportunities to argue why death is not suitable punishment for their particular client."
That can cover just about anything someone can think up and make fly.

What information was leaked that was not already in the public domain? Video of the car on the night of the murders may have been obtained by media at the time of the murders. The theory about what Kohberger did when he entered the house was already public information, and it's still nothing but a theory. What people said at the time of the murders, text messages, where bodies were found was all published in affidavits.

Does anyone remember any new information that they learned from Dateline that they did not know beforehand? Searching Bundy? Interesting, but irrelevant.

Info that Kohberger went from the DJ pool party to surveil the victims? That could be put together with cell data. Is cell phone data and screenshots of other women new info? Cell phone data? Is that the info that was not publicly known? What about Kohberger's family - did they have access to that info?
Someone sat on a chair in Xanas room and maybe left bloody butt prints? And some creepy Hoodie photos. I can't say the Facebook photos are something that would matter, but maybe? (Guys usually like pictures of girls. Just saying.....)

That's all I have. Anyone else?

I just can't believe JP already has a book coming out..I mean, I would want to wait on putting out a book until after the trial..you would have so much more information for the book! right????
Makes me wonder if JP is anti death penalty? Anyone know? TIA.

I don't think the car video in any way compromises the case. We already knew about the BK's travels.

The only way this leak would potentially lead to evidence being thrown out, is if the prosecution themselves leaked it. I don't believe that for a second. Normally, even in high profile cases, we have evidence like this by now (thanks to a preliminary hearing that didn't occur here). They'll find the leaker, punishment will occur, and that will be the end of it.

AT has had years to prepare for this, and there's no excuse for her not having all her ducks in a row in regards to the penalty phase. If she has the time to take on a second DP case at the same time, the least she can do is make sure she does everything promptly here. It's insane.
If not the prosecution then who? The defense?

Well, as we saw in early hearings, BK was quite capable of the famous 'steeple hands" position, which projects power and authority along with his suits and ties.

Now the Defense is probably requesting BK be allowed to wear a cardigan and slippers to court to sit in the forever lowering Defendant's chair, while he colors with Jumbo crayons. Hah.

Will he have his bible as a prop when court convenes?!

This would be a novel lane that I don’t recall hearing about before.

Imagine if the defense chooses that road——he is still encumbered by visual snow; he didn’t see that he stabbed four people. He didn’t even know he wasn’t in his own house, or whatever.

Of course he was somehow able to manage finding his own car. Maybe AT will claim he drove in circles because of residual visual snow. Or he went to gaze at the stars for so long because visual snow prevented him from easily seeing them.

Yikes. Judge Hippler may pull out what remains of his hair.

No. I think someone with access to the evidence, whether that be an investigator, a former investigator, a contractor, etc.

Something must be relevant tho. I remember MassGuy talking it up for us.
