I sometimes have that problem, too, from growing up in Canada. Even after almost 40 years of living in the U.S., everyone once in awhile I get it mixed up.
 
"It is time to try this case."

The defense complied with deadlines for pretrial motions and expert disclosures without ever moving for a continuance. After all of this, the defense requested a continuance to complete its mitigation investigation.

State argues that the defense has already covered the necessary ground in regards to mitigation, pointing to 55 defense penalty phase witnesses, and 132 exhibits they plan to use.

"Overall, the record before the Court shows the defendant's investigation has already plowed the necessary ground."

"...he ignores Idaho Supreme Court death penalty precedent holding that counsel is not required to investigate a defendant's entire life before he can be tried and sentence. He neither specifies additional areas for investigation nor explains what concrete investagory steps will bear new fruit at either the guilt phase of the penalty phase."

"...as such, defendant's motion amounts to a request for a perpetual continuance so that his counsel can go down every rabbit hole until defendant, rather than the court, deems himself ready for trial."

"A reasonable investigation does not mandate a scorch the earth strategy..."

State argues that the defense's motion is untimely, as if they were having issues meeting deadlines, finding experts, or pursing "red flags," they should have sought a discovery extension or continuance long before now.

"The victims in this case, including the immediate family members of the homicide victims, have a right under the Idaho Constitution to the timely disposition of this case."

The state concedes that pretrial publicity, to include Dateline, poses challenges for the court and both parties. But they argue that the jury selection process "has every chance to produce an impartial jury."

They say that the court has experience with this sort of thing, citing the high level of publicity surrounding the Vallow-Daybell trial.

They go on to argue that pretrial publicity is unlikely to dissipate as a result of a continuance, and that the cases cited by the defense occurred in the 1960's, when the media landscape was very different.

To sum up, the defense hasn't shown cause for a continuance, as they have already gone above and beyond in regards to mitigation preparation, dropped this request at the last minute despite having plenty of time to inform the court of issues, and the gag order violation can be remedied by jury selection.
 
My main interest centres on the victims and their loved ones feeling that BK has been held fully accountable. It will never be enough but they can hopefully rest a bit easier once that's done. I believe he is responsible and will eventually be convicted ( hopefully before the close of 2025). Jmo he should be in prison and separated from society for the remainder of his life.

On a more academic or sleuthy type level, I'm much more interested in the how of the crimes than the why. I'm looking forward to the prosecution laying out their case as Imo it's pretty clear they have evidence in spades.

I am in no way obsessed with why BK did this, although I do believe in psychologically trying to understand how murderers of this calibre become so, reaching the point where they 'cross the rubicon' as another poster sometimes words it.

But my more removed academic curiosity is mostly reserved for the how, and how the state will lay that out. I'm interested in the routes BK took to and from King Road, the FBI's 'art' of compiling and interpreting surveillance video to track his movements, the cell phone data, if when and where BK disposed of the Kbar, if and how he prepped his car.

I am squeamish but maintain an interest in the crime scene itself, any forensic reconstructions, the order of his movements and of the murders. His previous or build up activity near/ at the house also interests me, whether he surveyed the home from the back wooded area and also if he watched the front windows (the living area, XK's window, the ground floor windows). I know many of these latter questions may go unanswered but am hoping cell phone data, possible witnesses to his car being present at prior times, earlier preserved video footage etc. might provide some partial answers.

We know the discovery in this case is massive and I think the state has a hell of alot! Jmo

Not really concerned about them testifying, it’s what was behind a phone call to parents? That seems awfully cozy. Maybe if he had been in fourth grade and was only kid not invited to a birthday party … but this is grad school … the grown up world. MOO.

From what I know of Katherine, she's a lovely woman. Very smart, determined and enterprising. In this case imo, she's seen a door that's been left open and is peeking in - Meaning, she has seen a wide open opportunity. She's not only a very good forensic psych, she's an author of true crime (amongst other topics) and the fact that she's got such close ties to someone like old ghoul face is a golden egg to her. Can't really blame her tbh. Also, I think given her experience with the world of crime, victims and LE as a whole, maybe she made that phone call due to empathy... *whilst brainstorming the future book title*

This is rich. State reminds the Court that when they asked for access to BK to have him evaluated themselves, AT objected to the potential delay. (The judge ruled in favor of the Defense, such an evaluation couldn't be delivered in time, did not budge on the trial date.) But now at the 11th hour, AT wants a mystery continuance.

As it stands, BK has been diagnosed by their experts with ASD, OCD and ADHD. Like a gazillion other people on the planet. Good luck presenting those as mitigating factors! They're not mitigating! They're COMMON.

A gazillion people with that same string of letters don't kill anyone.

BK has had more resources, more stability, more opportunities, more latitude than most.

Makes what he did even worse for him IMO.

He chose it.

A million off ramps but he chose it anyway.

I look forward to the jury choosing his next exit.

I love the line “It is time to try this case.”
Same.

It’s basically the prosecution’s thesis statement, and everything else is supporting details.

In my layperson’s opinion, it was comprehensive, well-argued and bolstered by a review of all that has been already argued or litigated. The change of venue, et. al.

I particularly like that it includes the rights of the victims’ family members to have this trial begin already. They are the chief sufferers here.

Hippler Hammer Time. Please.

As the State pointed our, AT has not made a compelling argument for a continuance. More time for exploratory surgery on BK's childhood? That's not how this works. Or no defendant would ever get to trial.

AT  predicted threatened this moments months ago, and Hippler was way out ahead of her then. Mobilize your resources, hire more staff, worker harder, work faster, work better, no surprises.

This is not a surprise he'll welcome. Because it's comes as no surprise. But is also IMO an affront to the Court. They were warned precisely not to do this.

It will fail for lack of specificity IMO.

But not without offending the judge royally.
