It helped prop up their strawman theory of Odinists out in the woods performing virgin sacrifices. They wanted to show the crime scene to the public at large to stoke the flames of outrage so they could try to support their claim that Odinists and some larger conspiracy of having framed their client. The leaked photos came out (October 2023) just after their first fanciful farcical Franks motion was filed (September 2023). Worked pretty well, at least until it didn't. MOO

ETA I think they wanted the public to "see" the alleged Rune on the tree and the "purposefully" (According to them) arranged sticks and branches.

IMO they were trying to replicate the Karen Read trial strategy for jury nullification. There are two key components.

1. Work directly with social media influencers to build an activated supporter base.

2. File a bunch of wild/speculative motions that provide faux validity for your theories but actually are not intended for the judge. For instance Franks 3 (the geofence) contained conspiratorial content none of which they substantiated at the 3 day hearing yet we know from Murdersheet reporting that was linked to an alt suspect theory they were spreading online.

As you point out, I agree the point of getting the crime scene photos out in the wild was to 'validate' the conspiracies like the F contained in Franks 1 - things that had no business being in a Franks in the first place I might add.

As Holeman states, it is hard to understand how any of this can be justified in terms of a constitutional defence of your client. They go beyond pointing out doubt in the state case to spreading conspiracies in the hope a future juror will be influenced by it.

having worked in law firms large and small for decades, I can tell you that is not in any way shape or form normal to leave such items out in plain view when you aren't there. Reportedly they were in a conference room that "former" employee Mitch Westerman was allowed unsupervised access to.

The quotes around former tell you what I think of that ridiculous story. I think MW was still in their employ and was doing exactly what Badlwin and Rozzi expected of him.
EXACTLY. I grew up in and worked in my father's small law firm, and he would NEVER have left crime scene photos and documents under a gag order, left unsupervised in a conference room. It just wouldn't happen. And there would NEVER be someone, uninvited, just poking around in the inner offices. Those case files are highly protected from snoopers and you cannot just allow people to wander around unsupervised.

So it never made any sense to me that those photos were just out on a table in an unlocked, empty conference room. They were under seal by the court and they were just left unprotected? What a Clown Show.

MW said he went into the conference room to wait for AB. i.e he wasn't hiding - he was openly sitting in there.

So what did AB do when he found MW in the conference room with all the protected discovery?

It seems to me that some of the YTers would be hounding him for an interview. I'd like to hear his story, too. Maybe it will happen after his expungement is approved.

He "waited" for AB. Did AB ever come into the room or did MW say at one point to the receptionist "I have waited for a time, but now I have to leave because of other appointments. Greetings to AB!" and then drove away. Possible, that he never met AB this time. Or is there anything against it?

More than clown, intentional, a way to leak without direct breadcrumbs. Still needs real consequences from a judicial review.

Judge Gull tried the lowest level of consequences, having them remove themselves from a case. She likely thought their actions were thoughtless.

She did not perceive their actions as intentional, which needed a full review from a higher court of conduct.

I hope someone involved lodges a complaint to kick off a full reveiw of conduct.

I do really think the D could have felt they would benefit from the leak. At the time it occurred, they'd reached something of a zenith in terms of media frenzy with their "Odinite" plot theory. They'd found an audience. They may have felt (pure speculation) that viewers in tune with their conspiracy would be grasping at the photos looking for clues and that the D and their client would be viewed as victims of corruption and oppression, trying desperately to "reach the masses" with "the truth." It's jmo, but I felt at many points like they played this game.

Whether the leak was intentional, I have no idea, I would continue to hope not. The fact that the leak rebounded against the D and provided no benefit-- I wouldn't give the D credit because I'm sure they wouldn't have anticipated that result.

I give Rozzi and Baldwin no credit, because as RA's attorneys their obligation should have been to their client and not themselves, but they chose to stick with the Odin Theory regardless. I think they did it for the sheer shock and awe and SM attention it brought them. Ultimately it worked out for the best because in the end it led a jury of RA's peers to convict him and be sentenced to 130 years. Karma

I'm more than good with that, it's what Abby and Libby deserved. :) I have no doubt they are finally RIP.

The Odinist thing was to play on local fears.
There are hardly any people who are not caucasion of german and english descent in the area so the violent-tattoo-drug Odinists are the closest group to blame.
There are plenty of face tattooed gangsters if you look at the Indiana sex offender registry.


MOO B&R tried to pull at least one juror by their cognitive bias to a "can't say" hung jury result.

We don't know how close they came to succeeding.

I just did a search and it looks like Hidden True Crime had Holeman on their show about a week ago.

I thought Holeman did a good job on both TMS and HTC. He was probably relieved to finally put some of the crazy SM to rest.

To be clear - it wasn't shown to the requisite standard of proof that their actions were intentional

Gull stated that McLeland “proved by a preponderance of the evidence that defense counsel was sloppy, negligent and incompetent in their handling of discovery material.”

But despite once again calling the pair negligent and incompetent, Gull ruled that the prosecutor did not prove “beyond a reasonable doubt” that the defense team was “willful and intentional” in their so-called “sloppy” actions.

IMO it's actually quite a difficult position for the Judge to be in. On the one hand, AB clearly misrepresented his relationship with MW and the circumstances of the leak to the Judge leading up to and including the infamous in chambers hearing. On the other hand, the defence is able to obfuscate the situation at the hearing by claiming that sharing such sensitive information with ad hoc consultants is standard practice, while at the same time neither AB nor MW give any evidence to establish what MWs role or motivations were, or whether that is what they actually were doing.

So what can the Judge really do other than note the defence's double speak? Clearly she didn't believe a word of what they were saying.

It's better suited to disciplinary proceedings where AB will have to account for himself and won't be able to take the mickey.

As if they’re going to reveal anything groundbreaking they haven’t tried already. It will just be more fuel to the fires of conspiratorial actions or how they got the short end of the stick. Maybe this time the D can present EM a signed & framed print of a large cat head, thanking her for being such an animal lover or MW with a signed & framed print of G. Gordon Liddy.

Just trying to squeeze a few more golden eggs out of their geese.
