Hunter Valley bus crash driver to fight 32-year sentence

Brett Andrew Button will argue in court his jail term for a crash that killed 10 people was "manifestly excessive" and the sentencing judge "erred" on two findings.

The thing is - he took a plea to avoid manslaughter charges. I don't see that he has any room to argue down when he's essentially already reduced his potential sentence by plea bargain.

Considering Button’s actions killed 10 people died and 25 others were injured, he should be grateful for his sentence. It is not manifestly excessive. Think of the victims and their family and friends. Just man up and take responsibility for your actions.

I think he was probably under the delusion that he'd get a short sentence - months to a few years - and community service after, with his licence revoked. I don't know if he was given that impression by his counsel or if he's just that out of touch.

So he took the plea and then came the sentence, and now he is pouting and stomping his feet.

On Friday, 3 October 2025 the Court of Criminal Appeal will sit in Newcastle to hear the matter of Brett Button v R. The applicant was the driver of a bus that overturned on a roundabout at Greta in the Hunter Valley on 11 June 2023 while carrying guests home from a wedding. The applicant seeks leave to appeal against a sentence imposed on him by his Honour Judge Ellis at Newcastle District Court on 11 September 2024. And he lost the appeal. Good. He took a plea to reduce his sentence, he shouldn't then be allowed to reduce it further because it's more than he expected.
