“A panel of three judges have handed down their ruling on Greg Lynn’s appeal over the murder of camper Carol Clay.


Justice Emerton found there were a series of “serious irregularities” over the course of the trial, and a substantial misscarriage of justice had occured.”


Mr Lynn will return to court on January 28 for a mention.”

Meanwhile, get on with investigating the other matters in his past.

I had a feeling last night, after I googled Justice Priests farewell and some of his cases came up that pehaps this case might not go as I hoped.

But then it wasn't just him, there were two other judges who all agreed.

I’ve looked on the Court of Appeals site, but I really want to read the transcript/judgment summary. Anyone seen a link or document yet?

This is disappointing but I have hope that a strong case can be argued again.

I wonder if a judge-only retrial is appropriate, this is complex and high profile now, plus the recent information about Lynn that’s been made public.

Jury of peers is good justice, but I think it’s going to be complicated to argue murder with a jury who can’t be influenced by the circumstances of the other conviction.

I’m very interested to see how they navigate facts related to Mr Hill’s death in the retrial.

Very likely. It would be in everyone’s best interests if it’s put on ice, or pivots to covering the retrial.

That said, if they did their due diligence and produced the episodes with the possibility of a retrial in mind, with oversight by an in-house legal team, the information is in the public domain and factual. But… in my gut I think playing it safe is best for the victim’s families.

If I have this right the retrial is about Carol's death and that he can't be retried for Graham's death ?

I think the podcast will be put on pause til the trial is over,
and they will now change course to following the trial.
