Homicide investigators identified pertinent information and learned that Trista Spicer and the decedent, Eric Mercado, lived at the residence together. Investigators learned that Mercado had been reported missing by his family in 2014 and had not been seen since. Based on evidence collected by homicide detectives, it was determined that Spicer was responsible for the murder of Mercado, and an arrest warrant was issued for her. On September 2, 2022, Investigators with the San Bernardino Police Department located and arrested Spicer in the city of Yucaipa. She was booked into a local jail facility on the charge of murder. What on EARTH does makeshift tomb mean. That is such a grim thought. And it always feels a hundred times more devastating when the person is at home all along - I hope we find out more about this lady's mental state and what occurred in 2014, it feels like a missed opportunity that nobody did a quick sweep of the residence at the time.

Eight years ago, Eric Mercado suddenly disappeared.

Since then his family members have been desperately trying to find him. But within the past few weeks, police investigators got a major break in the case.

They found Mercado’s remains in what they describe as a makeshift tomb at his girlfriend’s San Bernardino home.
The 43-year-old woman is now under arrest for his murder.

His family wants to know why he was killed.

"He would come home, give us our kiss in the head all the time. 'Where's my baby? Where's my little sister?' He was very loving, very caring," the victim's sister Mahira Torres said.

Torres was remembering her big brother who vanished without a trace in 2014.

"It broke all of us. It broke our family apart. We all suffer from depression, anxiety. It's bad," Torres said.

During those tortuous years, Torres and her family tried everything to find her brother.
At the time of his disappearance, the 42-year-old lived with his girlfriend Trista Spicer at a home on East Davidson Street in San Bernardino.

San Bernardino police said a credible tip lead police to find his remains last week.

"The police came and told me to go inside the house," neighbor Anna Ling said.

Ling lives next door to Spicer.

She told NBCLA that investigators came to the home in late August to serve a search warrant.

She says they focused their attention on a hole at the side of the home, and also a shed in the back.

Human remains were found in what investigators described as a "makeshift tomb."

"It's strange. You hear of those 'Dateline' stories and you never imagine it's going to be happening next door," she said.

On Sept. 2, detectives arrested Spicer on suspicion of murder.

Torres says her family is relieved that his remains have been found. She is critical about the way San Bernardino police handled the case in the beginning.

"I want to know what happened to him," Torres said. "Did he suffer? Was he tortured? I don't know."

Spicer is scheduled to be in court on Tuesday.

She faces one count of murder and her bail has been set at $1 million.

Assuming she’s the girlfriend referenced in the original reports, her story never made sense. He got dropped off at HER house (their house? Shrugs), but SHE left at midnight when she felt sick. Why would she leave her own house, because she didn’t feel well?

New details about Mercado’s death were revealed during a preliminary hearing in the case on Friday.

According to a report from the San Bernardino Sun, the hearing centered on the testimony of Waylan Gentry, Spicer’s most recent boyfriend, who confirmed that he was the one who went to police with the information about Spicer killing Mercado.

Gentry, a convicted felon, reportedly told the court that he began living with Spicer in 2019 and the two regularly used drugs and alcohol. In 2022, Gentry said that Spicer was talking about moving from California to Illinois, where she had family, but that she had one important thing to take care of before she could leave, and asked Gentry to help.

The task, according to Gentry, was to help Spicer “get rid of” her boyfriend, the Sun reported.

“I didn’t know what she meant,” Gentry said. “She said he was buried under the stairs. I did not believe her.”

Gentry reportedly said he decided to go to the police after speaking with his mother, who told him to “do the right thing.” When police searched the home, they found a hidden storage compartment that was about 8 feet wide, 6 feet high, and 3 feet deep.

Mercado’s body was reportedly found in the compartment wrapped inside of a sliced air mattress.

The medical examiner who performed the autopsy on Mercado told police that his nose and eye socket appeared to have been “obliterated” and would have left him dead “within seconds,” per the Sun.

Records show that Spicer is currently scheduled to appear in court again on July 12.
