A 72-year-old superior court judge in California was arrested this week for allegedly killing his wife, accused of fatally shooting the 65-year-old woman inside their plush family home. Orange County Superior Court Judge Jeffrey Ferguson was taken into custody on Thursday and charged with one count of murder in the slaying of Sheryl Ferguson, authorities announced.

Ferguson, a former member of the U.S. Navy, started his legal career as a deputy district attorney in the Orange County District Attorney’s Office. He was promoted in the 1990s to senior deputy district attorney and had postings with the Major Narcotics Enforcement Team and the Probation Offender Search and Seizure Enforcement Task Force. Ferguson served as president of the North Orange County Bar Association from 2012 to 2014. He was elected to the Orange County Superior Court bench on June 3, 2014.

A Southern California judge accused of killing his wife texted his court clerk and bailiff admitting to the killing, prosecutors said on Friday as they charged him with murder and weapon possession.

On Friday, prosecutors charged Judge Ferguson with murder, personal discharge of a firearm causing great bodily injury and death, and personal use of a firearm, according to a criminal complaint.

According to California’s Constitution, a judge who is charged with a felony is disqualified from acting as a judge. A judge convicted of a felony will lead to the judge’s removal from office.

"Among the People’s concerns is the fact that a .22 rifle legally registered to Ferguson remains unaccounted for despite police recovering 47 other weapons – including rifles, shotguns, and handguns, and more than 26,000 rounds of ammunition – from his home during the execution of a search warrant," according to a statement from the Orange County District Attorney's office. "Another rifle, initially missed by police, was subsequently located in the home and turned over to police by defense counsel, but the whereabouts of the .22 rifle remain unknown."

An Orange County Superior Court judge said his son “will hate me forever” and should “punch me in the face” after the judge shot and killed his wife in their Anaheim Hills home, according to testimony at a hearing Thursday that ended with the judge being ordered to stand trial on a murder charge.

Judge Jeff Ferguson, 73, stands accused of killing his wife, 65-year-old Sheryl Ferguson, during an argument and in front of their younger son at their home in the 8500 block of East Canyon Vista Drive just past 8 p.m., Aug. 3.

Defense attorney T. Edward Welbourn argued there was insufficient evidence to show Ferguson intended to kill his wife, citing interviews with their son, Phillip, where he told a detective at least once that he thought the shooting may have been accidental.

Thursday’s preliminary hearing, where prosecutors lay out at least some of the evidence they have against a defendant, focused primarily on a trio of interviews between Anaheim Police Detective Michael Nguyen and the couple’s son, Phillip Ferguson, who was at the house when the shooting occurred. The detective’s testimony provided more details surrounding the shooting.

Prosecutors also called up three Anaheim police officers who testified to statements Ferguson made after he was placed in handcuffs that night.

Anaheim police officer Joshua Juntilla recalled Ferguson saying, “What did I do? My son will hate me forever. Can you have my son come over here and punch me in the face because I deserve it.”

Jeff Ferguson also asked multiple times if his wife was still alive, and he said he was “done for a while,” referring to going to prison, Juntilla testified.
 
Ferguson is an elected judge in Orange County, but he is not currently hearing cases and his name is no longer listed on the superior court's website. Under the state's constitution, a judge who faces a felony charge can continue to draw a salary but can't hear cases.

The prosecution presented a video recording in which Ferguson is heard confessing to the crime, reportedly saying, “I killed her. I did it.” Despite this, Ferguson has pleaded not guilty, with his defense attorney, Cameron J. Talley, maintaining that the shooting was accidental. Talley reserved his opening statement for later in the trial.
 
"We're not alleging he premeditated this crime. Facts don't support that but they do support that he intended to kill," said Senior Deputy District Attorney Seton Hunt.

In the text message, Ferguson said, "I just lost it. Just shot my wife. I won't be in tomorrow. I will be in custody. I'm so sorry.''

"He describes what he just did,'' Hunt said. "We all know what this means. He lost his temper and shot his wife.''
 
"You have been presented with evidence -- credible evidence -- he took out the gun, he was angry," Senior Deputy District Attorney Seton Hunt told jurors Wednesday in his closing argument. "He took the gun out, pointed at her and killed her."

Hunt said it was a "sad, tragic situation, but he (Ferguson) is still guilty of murder."
 
Phillip Ferguson said his mother’s last words were, “He shot me,” Hunt noted.
