Spanevelo and his attorneys notified the court of their plan to fight the death penalty decision after prosecuting attorneys motioned to set a jury trial date in April 2027. The defense argued that if the court does not strike the death notice, Spanevelo's attorneys would not have enough time before April 2027 to conduct a mitigation investigation and prepare for trial.

I flipping hope soThe United States Department of Justice is reviewing whether to seek the death penalty in the case of Marcus Spanevelo, who is charged with kidnapping resulting in death in the 2022 disappearance of Cassie Carli.
The review comes after President Donald Trump signed an executive order in January 2025 to reinstate the federal death penalty. The order directed the DOJ to reassess capital punishment eligibility in pending cases.
Spanevelo’s trial is set for April 28, but a final decision on the death penalty has not been made.
