Over three years after Navarre's Cassie Carli went missing, the Northern District of Alabama filed notice Oct. 5 that they will pursue the death penalty in her alleged kidnapper's case.

"The United States of America, through the undersigned counsel ... notifies the Court and defendant Marcus Spanevelo that the United States believes the circumstances in Count One of the Superseding Indictment are such that, in the event of a conviction, a sentence of death is justified," U.S. Attorney Prim Escalona wrote in a filing, "and that the United States will seek the sentence of death for the offense of kidnapping resulting in death."

Spanevelo and his attorneys notified the court of their plan to fight the death penalty decision after prosecuting attorneys motioned to set a jury trial date in April 2027. The defense argued that if the court does not strike the death notice, Spanevelo's attorneys would not have enough time before April 2027 to conduct a mitigation investigation and prepare for trial.

The review comes after President Donald Trump signed an executive order in January 2025 to reinstate the federal death penalty. The order directed the DOJ to reassess capital punishment eligibility in pending cases.

Spanevelo’s trial is set for April 28, but a final decision on the death penalty has not been made.
