The Infanticide Act only applies when the mother is found to be not of sound mind due to the effects of recently giving birth, ie, post natal depression. Its similar to the defense of manslaughter due to unsound mind, and yes that defense is available to strangers who kill too.

Anyway, that's Britain. I don't think Florida will be so lenient, they'll probably charge her with 1st degree murder.

I think she deserves it too. Thinking about it, even if she was in Britain she would probably be charged with murder, because she tried to lie and say someone else in the house did it. When you exhibit cunning and try to lie to the police, that steps all over any attempt to plead temporary insanity later.

Oh my when I read this last night I missed the link that he had passed away. I am so sad this little baby went through this. I really hope they find the mother to be mentally ill or suffering from severe post natal depression/psychosis because the other option just hurts my heart. All new mothers are tired and frustrated at some point but burning your baby to death with scalding water is just beyond cruel and evil.

I would give ANYTHING to have a baby as beautiful as Emilio... but unfortunately I am unable to be so blessed, but someone like this despicable peice of... (what I want to say would either be blocked or I will be kicked off this site) is able to.

A woman who ran her 2-month-old baby under a faucet of scalding water in 2012 pleaded guilty to second-degree murder on Tuesday.

Pinellas-Pasco Circuit Court Judge Mary Handsel sentenced Chekayla Dampier, 22, to 50 years in state prison for the death of her infant son, Emilio Jesus Bautista. Second-degree murder carries a maximum sentence of life in prison.

The plea deal was made just before the trial was about to start and after a witness died. The witness who had been expected to help the defense's argument that the baby's death was an accident died overnight. Ana Hernandez, 53, who had flown in from Perth Amboy, N.J., was found dead in her hotel's swimming pool around 2 a.m. Tuesday, prosecutors said. No details about her death were released.
