Imagine if Harvey is arrested and is then in Tallahassee!

A hypothetical Adelson family reunion in Homestead, FL and Florida City, FL would achieve the supposed State of Florida Justice for Dan Markel

• What is ironical would be the hypothetical indictment, conviction, and LWOP sentencing of both Harvey and Wendi Adelson such that 1) both Charles and Harvey are/could be at Dade Correctional Institution and 2) both Wendi and Donna are/could be at Homestead Correctional Institution
• Such hypothetical arrangements would be favorable to their relatives such that Wendi’s sons and Robert Adelson’s family might want to visit them in one trip
• Also, such hypothetical arrangements would be beneficial to the incarcerated because they all could enjoy the relaxed in a “resort like” settings with a lot of extra activities such as education, religion, and fitness at these prisons
• However, the State prisons will not allow the incarcerated to communicate with each other albeit they are housed in the same or near-by facilities

I thought Harvey would have to be jailed in Tallahassee until his trial.
He may not make it to prison at his age.
Why would Robert want to visit any of them?
Are you speculating that Charlie be transferred back to Florida? I guess if he talks it’s possible.

Sorry, the updates are coming in fast.

DA is now at Homestead CI, in southern Dade County. She apparently was granted the request to be closer to HA. Homestead has a reputation for having facility problems but a former inmate recently said that Homestead officers treat prisoners with respect and dignity vs. Lowell. It will still be a 1 hour one-way drive for HA but much better than the alternatives.

I think thats one of the prisons where a senior can get A/C.

I thought Harvey would have to be jailed in Tallahassee until his trial.

Depends on what charges he is arrested on, if it ever happens. The two lesser charges have a $5000 bond, each.

That would be at least 7 months for the oldest and 10 for the youngest.
Could it be Kastigar issues are making this take longer than usual?

DDTC (Mentour) did a good video on this subject yesterday.

Kastigar v. US (1972) is at the Federal Courts level. Not every State criminal case reaches the Federal Courts.

• Please, notice that Georgia Cappleman started Wendi Adelson’s 4 examinations with a set of legal questions to the effect of: 1) are you a lawyer? 2) what is "use and derivative use" immunity? 3) do you get "transactional" immunity for your testimony today?
• These questions are setting the groundwork of the validity of Wendi Adelson’s testimony as she is compelled (subpoena) by the State to testify against a defendant despite her 5th Amendment rights
• These questions also preclude Wendi Adelson’s potential claim of State extended immunity for any evidence the State would be able to develop independently (not from her 4 testimonies) against Wendi
• Should Markel first degree murder case, of any State criminal case, reach the Federal Courts, Kastigar v. US (1972) is rather adversarial to defendants (favorable to prosecutors) because it clarifies the difference between 1) "use and derivative use" immunity and 2) "transactional" immunity
• Kastigar v. US (1972) makes clear that "use and derivative use" immunity does not protect from independently developed incriminating evidence
