Death sentence tossed for Florida mom of Baby Lollipops
"MIAMI (AP) A Florida mother condemned to die for the beating death of her young son known as Baby Lollipops deserves a new trial because of inflammatory and improper statements made by prosecutors during closing arguments, the state Supreme Court ruled Thursday.
The justices tossed out the 2011 murder conviction and death sentence for Ana Maria Cardona, 54, marking the second time the court has reversed her case. Cardonas original 1992 conviction and death sentence was overturned because prosecutors failed to disclose key evidence to the defense.
This time, the court found that Miami-Dade prosecutors crossed the line in closing arguments during the second trial, repeatedly attempting to stir up juror emotions and sympathy for the 3-year-old victim, Lazaro Figueroa. Testimony showed the boy had been severely beaten and suffered from chronic neglect, weighing only 18 pounds when his body was found in some bushes in Miami Beach in 1990..."
Jury selection began Monday in the trial of 56-year-old Ana Maria Cardona, who received the death penalty in 2011 after she was found guilty of torturing and killing her son, Lazaro "Baby Lollipops" Figueroa, in 1990, and discarding his body outside a Miami Beach mansion.
Last year, for the second time, the Florida Supreme Court vacated the conviction of Cardona and ordered a new trial, citing improper comments made by a prosecutor in the closing arguments.
Opening statements are set for the third trial of a Florida woman accused of killing her toddler son in what became known as the “Baby Lollipops” case.
Court records show trial will begin Monday morning for 56-year-old Ana Maria Cardona, who faces life in prison if convicted. Two previous convictions and death sentences were tossed out by the Florida Supreme Court. Prosecutors decided against seeking death a third time.
The death of her 3-year-old son Lazaro Figueroa was huge news after the boy’s body, weighing 18 pounds (8 kilograms) and badly beaten, was discovered in the bushes of a Miami Beach home in November 1990. Police initially could not identify the boy and called him “Baby Lollipops” after a design on his T-shirt.
Cardona was initially convicted and sentenced to death in 1992, but the Supreme Court overturned the conviction because prosecutors failed to disclose key evidence to the defense.
Prosecutors had decided against seeking the death penalty this time.
